Thai spouse tourist visa to US denied.

Or I can just not answer any more comments. A couple of them have been ignored due to not really saying anything. But then I assume since people keep commenting, they are happy to continue the discussion. As I mentioned, I like a good debate on anything really.

Yeah, I can guarantee that congress won't amend the INA in such a way that B applicants are not presumed to have immigrant intent.

There are millions of Americans living permanently abroad. The list of countries is vast no doubt. Perfectly happy with their own citizenship, the spouse isn't interested in getting a US one as well. When the preponderance of evidence, if examined, indicates a settled domestic situation in the home country with an American citizen, and both wish to travel, it is deserving of a more generous consideration.

Sounds like the current situation

I know that as visitor visas go, being married to an American expat and stating you would be traveling with them to visit family, has no significance. That is the gist of all of the comments in the thread. I think most Americans who have never dealt with embassies and consulates, think the US is a welcoming place if you go through the legal process rather than cross a border in the night. Reality is different. My family there is quite in shock that such a simple thing as a visit by a son/brother/father/grandfather, with his wife, is being denied. But none of them have dealt with embassies before. They have a somewhat sheltered view of things.

I think it's very significant, just not necessarily a positive factor.

555. That is Thai for ha ha ha. :) Yeah, neither my wife or I view the fact as a positive. We both get better receptions at the Australian embassy. As I mentioned above, I was in the embassy at the same time as my wife, getting a new passport. I have not had one since 2004. The guy seemed shocked and asked how I got into Thailand. I said dual citizenship. He asked to see  my other passport. He went away with it, came back and said they were just checking the validity of it. When he brought it back to me he said, "You can keep that for now". I said, "Well it is mine". Got a bit of a sideways look for that.

Each country makes its own rules, so it's not surprising that your experience differs from one embassy to the other.

 

I hope you get to visit your family soon, and hopefully your wife can join you on a future trip.

in US non immigrant visa applications you are indeed “guilty until you prove you are innocent” - that is what the effect of the legal presumption of immigrant intent does. Getting a visit visa as the spouse of a USC is harder. Fact. You may not like it, you may not agree with the law and the reasons, but they are what they are.

They don’t print a checklist because people game that (example getting a relative to lend them the correct amount of $ to show in their bank account), and circumstances differ per country. More than three quarters of Thai applicants get approved for tourist visas. Fact. I’m guessing very few of those approved have USC spouses. (Educated guess, not fact.)

 

Yup, it’s indeed going round in circles, when it’s really very simple as described above. I would indeed expect a moderator to put an end to this fairly soon.

 

 

 

I sort of figure I am retired and enjoy engaging conversations. If you can't be passionate about something, might as well give up. And no one has to comment or continue to. But, I suspect it's not just me who enjoys a thrust and parry on most any topic. After all, you came back.  :)
