What happen if couple seprate before cr1 visa interview can spouse attend cr1 visa interview please help and not divorce yet

What country are you from? American Spouses typically don’t attend CR1 interviews. Also if you are planning to divorce why are you following through with immigration?!?

The petitioner should withdraw the petition by contacting:

USCIS is the petition is still at the service center.

USCIS and NVC if at that stage.

USCIS and consulate if at that stage.

Acctually am from india and i was waiting for interview and my wife from us say she can't continue this marriage what i want to live with her so the question is can i attend interview if i received interview

No, you should not attend the interview if she has clearly stated she wants to end the marriage.

If she wants to end the marriage then you should.

 

You don't have a path to the US thru her.

Why would you think you should attend an interview if your wife no longer wishes to be married

Its just alot misunderstandings happen i want to clear as person thats why i ask if any way i can reach to her

If you got the visa, and later she let immigration know she was not with you anymore by the time of the interview, you will be in deep trouble.

You can attend the interview but be sure to tell the interviewing officer that your wife has said she wants to end the relationship.. 

 

in all honesty, if she wants to end it, there’s nothing you can do, you lose your right to any immigration benefit.. if you do go to the interview and you fail to disclose your wife’s intentions your placing yourself in a very dangerous situation e.g. possible fraud due to misrepresentation of the relationship and possible homelessness financial hardship within the US should you arrive after she’s already said it’s over.. 

 

I recommend you either try fix the relationship and confirm your wife’s wishes prior to going to the interview, secondly if she continues with the desire to end the marriage, notify the consulate/NVC/USCIS prior to your arriving in the US

How long you two been married for? And you said misunderstanding between you two caused her to think of ending the marriage and why at the very end of your immigration journey. I would still recommend you to go to the interview take what ever evidence you have with you to the interview and if you get the Visa then hopefully you can clear the misunderstanding between you two in person.

Not good advice. The wife has the right to withdraw from this. And the OP has to allow her that right. Going to the interview and getting the visa and then coming here puts the wife on the hook for the I-864, potentially for the rest of her life. That’s why she has the right to withdraw at any stage prior to the visa being issued. If he’s wanting to clear up misunderstandings with his wife, this is the wrong way to go about it and will only add further “misunderstandings”. She may have good reason to want to withdraw - we only have one side of the story here. 
 

OP, the immigration process is very stressful for all concerned. Many couples find the pressure of being apart causes problems in their relationship. Take time to talk things through with her if she’s open to talking with you. If you are still at the NVC stage you can delay things there whilst you work on the issues.

We are here to help without judgement what ever happened in between these two is their problem. He asked for advice I gave him one and besides he wouldn't be asking to go to the interview any way if his wife had already withdraw her petition for him. If his wife wants to withdraw her petition she can without any pressure any way.

We already documentary qualified and i can still check my case status on ceac portal
