Just called USCIS customer service.

I asked if I could schedule an infopass to get the stamp.  I was told they will only schedule infopass for me if I have a receipt number. But if I have the receipt, why would I need a stamp?

I also asked if they could give me any estimate on the current receipt processing time. The agent I spoke with advised me to call back next week. They received my package on 11/30. I asked if their current receipt processing time is about 6 weeks. The agent didn’t say yes or no, just said they are having “high volume”.

I am currently employed, but I am worried that if my Green Card expires before this gets sorted - what are my options? Do I have to stop working?

I was wondering the same thing and I found that on USCIS website :

Quote

5.1 Reverifying Employment Authorization for Current Employees

Reverification is never required for U.S. citizens or noncitizen nationals. Reverification is also never required when the following documents expire: U.S. passports, U.S. passport cards, Form I-551 (Alien Registration Receipt Cards/Permanent Resident Cards, which are also known as Green Cards), and List B documents.

https://www.uscis.gov/i-9-central/handbook-for-employers-m-274/50-completing-section-3-of-form-i-9/51-reverifying-employment-authorization-for-current-employee

Quote

10.4 Avoiding Discrimination in Recruiting, Hiring, and the Form I-9 Process

You should treat individuals equally when recruiting and hiring, and when verifying employment authorization and identity.

You should not:

  • Request that an employee who presented an unexpired Permanent Resident Card present a new document when the Permanent Resident Card expires.
  • Request specific documents for reverification. For example, you should allow an employee who presented an unexpired Form I-766, Employment Authorization Document, during initial verification to present any document from either List A or C during reverification.

https://www.uscis.gov/i-9-central/handbook-for-employers-m-274/100-unlawful-discrimination-and-penalties-for-prohibited-practices/104-avoiding-discrimination-in-recruiting-hiring-and-the-form-i-9-process

So I think you can keep working and your employer can't ask to verifying you.

Does that mean, if my Gc expires in Feb, if I start the job now, they should be able to verify me using my current GC?

I think so, maybe someone on the forum knows better than me but I think as long as they verify your green card when it is still valid they are not supposed to ask you anything else after it expires. If you start the job now they are going to see anyway that your green card expires next month and might ask about it though, not sure how it works.

I had a seasonal job from mid-October to December and my GC expires on January 11. It may not have been a permanent position, but I got no hassle from HR for using my expiring GC to verify my right to work.

If I actually do get a job before my extension letter comes in (which seems to be taking excruciatingly long time right now), I was planning to use two documents allowed by the I-9; an unrestricted social security card and my valid ID since I am here legally--just waiting USCIS to do their due diligence.

I had a CR-1 visa so I got an unrestricted social security card from the beginning. This option might not work for those who came to the country with a K-1, though, unless you had your social security card replaced with an unrestricted one. And apparently as mentioned earlier in this thread, some states do not issue a DL/ID with longer validity than your I-551.

Getting there, slowly but surely...  (I hope )

Together (well...mostly the Transatlanticism kind of together) Since 12/2013

CR-1:

Married in Sweden 8/2017
(Well Frontloaded) I-130 Sent 12/2017
CR-1 Approved 10/2018
POE LAX 01/11/2019

I-751:

I-751 Package Sent with UPS 11/11/2020
I-751 Received by the AZ Lockbox 11/13/2020
I-751 Check Cashed 12/31/2020
I-797 (with My Last Name Misspelled...) Received by Mail 1/2/2021

Biometrics Appointment Received by Mail...too bad I am in Europe right when it's supposed to take place 🤯 6/14/2021

Rescheduled Biometrics Appointment, the biometric technician can't change the misspelled name on file, but he enters the correct spelling of my last name as an alias 8/2/2021

Interview Ready to Be Scheduled 10/13/2021

(Two Days Later) Interview Was Scheduled 😱 10/15/2021

I-751 Interview, Petition Approved 🥳 11/19/2021

Case Status Changed to New Card Is Being Produced 11/19/2021

Case Status Changed to Case Was Approved 11/22/2021

Green Card Arrived in the Mail (Name Correctly Spelling, w00t) 11/27/2021

When USCIS Misspells Your Name:

Typographical error form filled on USCIS website 1/4/2021
Contacted USCIS if there has been any progress since THEIR error (Received a Tier 1 tracking number) 2/6/2021
Contacted USCIS again as the issue remains to be resolved (Received ANOTHER Tier 1 tracking number) 3/12/2021
Apparently USCIS chat is worthless; CALLED USCIS, Tier 1 agent promised that a Tier 2 agent would call me 4/28/2021
Received a call from a nice Tier 2 officer who said I may or may not get a correct extension letter, but just in case I would be scheduled an InfoPASS appointment 5/4/2021
Went to local USCIS service center and had to deal with a nasty and entitled customer service agent who refused to give me an I-551 stamp. National Benefits Center is supposed to mail me another I-797 within 7-10 days... So I had to waste my day, taking buses for two hours one-way just to deal with this lady's attitude? 5/7/2021

After anxiously monitoring our mailbox for a few days I DID receive a corrected I-797, w00t! All documents good to go Vaccinated Ready to visit my parents in Europe for the first time in 17 months!!  5/13/2021

The lesson: Don't use the chat for anything complicated, AND keep hassling USCIS for a response...

Not sure if I agree. I recently contacted the congressman in my district since I have a potential job opportunity. They asked me for job offer to request expedite. If you can prove you will suffer financial loss, they can assist to request expedited service from USCIS.

Let’s be specific

you Contacted them to do what exactly?

OP asked about contacting about his NOA. His is not expiring till like February so am not sure what a congressman can do when his file can’t even be found yet. It’s not like it expired and now you’re in Jeopardy or something

weve seen in the past particularly on EADs. If u got a job, u now have a REASON to get ahead since processing is so slow.

just because ure stressed and worried that it’s been a while isn’t a reason for expedite- that’s what am saying.

I want to know too. Do we need to let the HR know? Or we can keep working?

I’ve been told that When u are employed already, an employer CANNOT ask for recertification of status.

so even if ur documents expires, u’re good.

Continue working and go about ur business.

if for some odd reason something crazy happens, u tell them u have filed for renewal and that’s that.

it only becomes challenging if ure looking for a new job and will need it to get into their system from the get go
or for those where their state license expires with GC, then getting that NOA ASAP is crucial

Hello Emekus, can you apply for a job with just your DL and a expires GC? My DL won’t expire with my GC.
and what does having a SS restricted looks like? Mine doesn’t seem to say anything like that.

thank you

Yeah! It's definitely something! It's obvious based on our google spreadsheet that they literally have not touched any ROC applications since 12/17. I called USCIS today and no updates! I'm going to give it until 1/8 then might consult with an attorney. They told me to call them back when it's getting closer to GC expiring within 30 days, i said that would be literally next week! Haha. It sucks that there is no communication from the lockbox facility. The last stakeholders message from them mentioned 30 days of receipt notices which is obviously not what's going on!

This is frustrating,i  get that this the holiday season and there is limited staff, but some movement would have been nice...

I would keep in mind that not every single person that filed the form is on vj. I'm sure there was some movement. Stay positive! Let's hope we all hear something soon! 🤞🏼
