Since you are filing the petition jointly, I think the cover letter is better use the word "we" rather than "I" alone. And the letter signed by both party. I did it this way tho.

Can I still work while waiting on NOA1? My green card expires on Jan 3rd and I sent over I-751 documents in the middle of November. With all the process being delayed, I am not sure if I receive it in time. Not sure what I am going to tell my employer.

legally they cannot fire you for this immigration delay. they would have to consult the HR department on that or call USCIS themselves. they can ask you about your status, but just explain you have filed for ROC and that is all you can do till NOA shows up. My is a WFH employee and her GC expires on Feb 14 2021. All that have filed in november here are in the same boat

@darymak if the employer gives you problems for immigration paperwork that is out of your control (if you have flied on time) IMHO, it's not someone i would want to further be employed by. Ride it out, save your pennies for an emergency and hope for the best if they really don't understand your situation. Just an opinion. Like stated before the employer has the last resort to consult USCIS directly on how to handle this situation. Firing is an excuse, unless they wanted to do this from the very beginning.

Don't think your current employer can ask for reverification of employment authorization. It should not be a problem for your current job. But you will need the I-797 NOA and your expired Green Card if you apply for a new job to verify that you are authorized to work. It is better to talk to your HR and have them confirm.

Mine was sent on 10/28 and received on 11/02. My credit card was charged on 11/04. I called USCIS today and they gave me the receipt number. They have mailed the NOA on 12/04 so it should arrive in mail any day now.

 

Don't worry, you will get an update within this week. You should call them again on Wednesday and then Friday. Good luck!

Cover letter is not required

However, theoretically speaking, the person seeking conditions to be removed should write it
However, this is a JOINT petition. I had my hubby (the immigrant) write it but we both signed it.

Hi everyone, I came on the boards because I was getting stressed out that we hadn't heard anything after submitting on 11/11. I'm not sure if the fact that none of us have heard anything is a comfort or not! Sending strength to you all.

From what I'm reading here it seems like people are saying we should call USCIS after it's been over a month if we haven't heard anything? My GC expires on Feb 4th.

Its taking a good 30-35 days at the minimum and you shouldn't be stressing like me(11/18). We all are with you in the same boat :)

One can always call USCIS
At this rate, am not sure what help it's gonna give u when you got 2 months to go

I just read through some older posts in this thread and am suddenly a little worried. If USCIS doesn't open my package until after my greencard expires, will it count as filing late even though my stuff has been laying in their PO box for a month? Logically I'd think as long as the post office stamp shows it was sent before my greencard expires I'm in the clear, but now I'm worried.

I called USCIS today about the same question bcoz my GC expired in two days. The representative told me it takes 30 business days now to process the application from the received date. And as long as my application delivered to the lockbox before the GC expiration date, the rest is out of my control. So if you are worrying about it, call them up to pull out your record to see what happen at least 😆

Did you get I-551 Temporary Evidence Stamp in you passport? If you did, when did you apply for InfoPass appointment? How long it takes once you are in the building and what did they ask?
