I posted this question in a thread I started but I didn't get any actual answer.

Can someone/everyone tell me what you put in the attached highlighted box? It's listed in a section regarding the spouse (me, US citizen) , but it's in regards to the ACS appointment. We can not find any answer as to who, and a bit shocked more people are not confused. Are we missing something, cause we read the instructions and this section over and over again. HELLLLLLP ME!!!!!!!

The US Citizen or the petitioner's spouse has to fill in section 8, and the name with initials should be put in the highlighted box. I'm not sure why you are confused about that though.

 

When I (petitioner) filled out the form, the highlighted box in section 8 was automatically filled in with my wife's (US citizen) name with initials. However, the same box in section 7 was not automatically filled in. I had to use a pen to write my name with initials.

Looks like people in the October thread who sent in their packages late last month are finally starting to get NOAs. So @emekus94 approximate dates might well hold true for us 😳 So at least another two weeks of waiting as our package was received on the 13th 🧐

I asked a pretty valid question. Why am I, the US Citizen, having to go to any ASC appointment  for fingerprinting/pictures when the wording CLEARLY states it is "to re-affirm that all the information in my petition is complete, true and correct". "By signing here, I declare under penalty of perjury that I have reviewed and understand my application, petition or request as..." This application/petition is for the foreigner, as they are the ones asking for the removal of their conditions. This was never apart of any other process for the US Citizen. My husband went to an ASC appointment in Mexico the day before his interview, and he went to the next one when we submitted his adjustment of status petition. 

I am looking for a valid explanation as it makes zero sense. I'm sorry (not really sorry) for questioning the process. 

Honestly, the fact no one else questions this is strange to me.

As far as I know, the US citizen may require to go to an interview if I-751 application is filed as a joint application. I think that's why section 8 is worded like that. For an example, my wife and I both went to the AOS interview before I received the conditional Green Card. And section 8 has a "if applicable" clause attached to it as well. "If applicable" comes into play in a situation where the petitioner and the US citizen are divorced. 

 

It states at the end of section 8 that the petition may be denied if the spouse fails to completely fill out the application. As far as I know, the spouse MUST sign section 8 since this is a joint application. It is also mentioned in the instructions as well.

 

To answer your original question again, your name should go in the highlighted box in section 8, you MUST fill out section 8 and sign it as well. If your question is about why you have to do that, I think it's a decision of USCIS and we should just play along. I honestly do not see any advantage of questioning the process.

We're in MA, and my suggestion is give it a try. It won't let you renew online, but you can get an appointment to go in person and talk to a human. My husband went in September with his GC (expires in March 2021), and they gave him a DL that's good for a year! He thinks it might be a combination of Covid-extensions and also the RMV employee not giving a , but definitely worth a try.

 

I was really surprised that it worked, because they would not budge an inch when he tried to get a learner's permit while we were waiting for our AOS to go through. That was the worst.

Awwwww you have been waiting for almost a month. I hope you hear back next week as well, at least they should be keeping it within 30 days.

I am not at all offended, I just still don't understand the wording for why the US citizen would need an ASC appointment. I went to the interview as well for the AOS. This is something completely different, and the wording indicates that the petition is based on the US citizen and it 100% is not. The foreign spouse is asking for the removal of conditions. YES or NO?????  We are only signing the petition as we are the reason for them being here. Nothing more, nothing less. I am fine with signing this damn thing. But that is NOT what I am questioning, and I don't think you are understanding that. entirely. Even if the US citizen was living abroad, which I was doing the K1 process with my "fiancé", and I had friends do the process from outside the US as well with their spouses, they didn't have to go the the ASC portion of the process. What picture and fingerprints are needed of a US Citizen? I know you can't give me an actual answer, and I am just beating a dead horse. And again, the wording states that this petition is that of the US Citizen and that is not correct. This is insane, really. 

I need to take this to an Immigration lawyer. I am not signing a government form that makes absolutely zero sense. You may not see any advantage as to questioning it,  but you can't speak for me. Fact is, you, and others signed something that is not correct with zero explanation, just because you were asked to. I am not one to ask "how high" when told to jump. Sorry, but this is bothering me to my core. :ranting:

The NOA is your extension letter with expired GC. That is supposed to be sufficient to travel. I have no experience  doing it, but do call the airline and verify they will let you board the flight back to the USA. I have read of VJ having problems in the past cuz the airlines are what is a extension letter? And later missing their flight
