I don't care who is going to win this election. But im hoping that the immigration process would be fair for everyone. No short cut.

Yeah, but many sponsors have multiple petitions that could potentially come due at different times depending on when i130 was submitted e.g. parents and siblings ... if all of a sudden they all get the ok to come live in the country that’s a significant financial commitment if these people are still awaiting GC or EAD... and if they’re given EAD that’s a massive influx of people into the job market... the other scary thing is if or not Biden is for letting new immigrant or whatever they’ll be classed as on to public benefits since public charge will be killed off under him... now the tax payers are supporting them

I just wish for Biden/Harris presidency actually comes up with an effective immigration reform plan and actually execute it for everyone, dreamers, undocumented immigrants, asylum seekers and fix the USCIS slow down, which came to be with Trump, he was the cause of this ridiculous wait times. Never in the history of immigration processes, did a i485 take 18 months or n400 24 months...EVER. I  be am very hopeful of the new presidency and we also need to understand it’ll take time to try and mend the brokenness Trump is leaving behind 🙏🏽 I have very strong hope for the country I love and left everything behind for 🙏🏽

Not sure how trumps the cause of people with PD’s as far back as 2010 not yet having their GC but ok... did it occur to you that each year more and more people are applying for immigration benefits and that that might be one reason as to why things have slowed....  what about the fact that USCIS isn’t actually a government run service that it’s paid for by applicant and that congress (not trump) refused to provide them with covid financial relief in addition to stopping them from increasing fees that would of helped them keep staff and/or hire more staff to help with processing applications? Nope, just trumps fault 🙄

Public Charge

 

Biden would reverse Trump’s public charge rule. He believes the rule runs counter to American values and the history of the nation.

 

Reversing Travel Bans

 

On Day One of his presidency, Biden intends to rescind Trump’s travel bans on travelers from 13 countries, most of them either majority-Muslim or African nations.

 

Skilled Workers

 

Biden supports reform of the H1-B system including increased alignment to the current workforce.  Once reform is complete, he plans to expands the number of high-skilled visas.

 

Refugees

 

Biden supports raising the annual allotment of refugee admissions to 125 thousand from around 15 thousand under President Trump.

 

Mexico Border Wall

 

Biden plans to immediately stop diversion of US Defense funds for the border wall, effectively stopping its expansion.  Trump will immediately prioritize reunification of "lost" children from asylum camps with their parents.

I’d imagine Trump can extend the proclamation to the last day he is in office. No one can answer these though. It’s all speculation.

The public charge rule has always been on the books even before Trump

Actually yeah they have. It's was routinely around 9-12 months even as far back as 2013. So the addition of more petitions and a pandemic has only made the timeline longer. Also the N400 is dependent on your local office for example down here in Raleigh is around 6 months while up there in NYC it is much longer than that. 

Don't assume that your case is the same thing as everyone else's. Also don't complain about how long your AOS took when you did a I130/485 at the same time.

Will these applications go forth now or will they require new applications ?

this year's DV lottery makes the person need a passport (did not require this in past years) / that being said,  it is hard for many to apply for a passport in these times and limits many.  i wonder if this will change in the future.

And what of the DACA people that have already had court dates?   will they be reconsidered?

 

any thoughts on any of all that will happen because of the changes? Politics aside / just the proceedures that may take place

If you or a close family member of friend has not gone through an adjustment of status that is marriage based then your reasoning is invalid. Prior to 2016, an adjustment of status and a citizenship application would NEVER last more than 12 months at most, NEVER. A straightforward case? NEVER. Based on your nationality, wait times for your particular country of origin differs by A LOT, so those wait times may be a normal thing for you and yours but it is not for me or mines.

Actually yeah they did go past that timeline. My wife's AOS took almost 11 months and there were others whose took much longer than that. So don't base your experience on what you think is happening. My nationality? My nationality has nothing to do with AOS or N400 timelines. It is all based off of the local office, which down here in NC the N400 has been taken at most 6 months
