What did you answer for the AOS category? (a) or (c)?

Did you send your NOA2 from the K1 application?

What fee did you send? $1225?

Did you sign all the forms?

If you married within 90 days of arrival via a K-1, the I-130 is not required.  Please be more specific about what they are asking for.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Pretty sure that falls into this category as the reason for rejection was "priority date could not established."

 

1. We answered C09 for the AOS.... I think? What number is this again? Sorry just going through this paperwork again.

2. Yes that's the I-797 right? That was attached in the packet. Does this need to be directly attached to the I-485?

3. Yes sent a credit card form for $1225 which they notified was destroyed

4. Yes all forms were signed

 

And we also sent a table of contents.....

C(09) is the EAD classification,  

 

On Part 2 . Did you tick 2c. ?

The priority date sentence is not the reason for your rejection, it's the consequence of your rejection.

 

Yes, the NOA2 is a supporting document for the 485, so it should be with it.

 

The credit card could've been the reason too. Sometimes the bank rejects because of the amount.

ok post the RFE than people might have clarity to respond. your app might have million ways or rejection and one of them could be the lockbox guy just was lazy.  Always remove any identification info from the RFE before posting here .

In this case posting the RFE would not help. RFEs are generic and the info the OP provided saying 'priority date can not be established' and asking for the 130 means something was filled out incorrectly OR the mailroom worker incorrectly rejected it. It is rare that things get rejected incorrectly because when something is rejected several people have to sign off on it confirming its to be rejected.

 

OP- please check the example forms- https://www.visajourney.com/examples/INS-Form-I-485.pdf  Most likely the error is as already posted by @payxibka page 3 (2c).

Annnnnnd you guys are right, we checked the wrong box for page 3 # 2c. Man that is dumb. Thank you for your help.

 

Next question: should we replace this page with corrected info and re-submit everything as is, or totally re-do the I-485 as if we were submitting now for the first time? I would of course like to avoid the increased fee if possible.

The increase in fee has been blocked by a recent court case.

And some set of fee increases will likely be happening regardless of who's in charge; the new fee structure had a lot of changes that we (as mostly marriage-based applicants) didn't like, but USCIS's revenue shortfall isn't going to magically go away.
