For our divorce we did not involve a lawyer at all except for the definition of the financial arrangements and the transfer of property. When my ex went to the court with the request for the divorce absolute they told him that the divorce was final from that moment. It took about 2 weeks for the court to mail the certificate to me. The involvement of the lawyer was minimal but he was the main cause of any slowness in the processing of our divorce.

17th March 2010 - Started the removal of conditions process

22nd March 2010 - Application received by CSC

30th April 2010 - Biometrics appointment

If you were the respondant in the case, maven, then you wouldn't have had to do anything to get the absolute (nor would your lawyer). It can only be applied for by the petitioner.

Nope, I was the petitioner!

It took FOREVER to get everything squared away. We split amicably in April 2005, filed in March 2006, split everything down the middle. Took until early November to get the nisi, mid-December for the absolute, and on June 19th (last week!) I FINALLY got the consent order allowing me my loot.

Lawyers. Meh. (And yes, I trained as one too... :whistle: )

Interesting! I guess if you didn't sign for anything to get the absolute rolling, that the lawyer must have had 'permission' to sign on your behalf. Cos I do know that the absolute can only be applied for by the petitioner.

Luckily, Chas' ex was very prompt and did everything she said she would. And no lawyer to slow them down, either!

Yes, I had given her permission to sign, in the false hope that that would make things go more quickly. My ex did the same. Now, you would think two lawyers getting divorced would know better than hire solicitors (not that either of us knew a monkey's about matrimonial law -- but we do know lawyers! :lol: ) but both our solicitors sat on the docs on several occasions.

I found a little poetic justice in the fact that my consent order for the dosh was finally handed down the very morning that Bruce (Husband No.2) was granted his visa. Yes, that was a very fine day indeed for the maven! :devil:

For those of you who have been through a divore in the UK, how long did it take to get the Decree Absolute once the waiting period was over from the Decree Nisi?? Its all signed, but "in the courts". My fiance has been waiting for his for what seems like forever! I'd like to know what to expect since his solicitor is always so vague about it, saying things like, "soon". She initially told us definitely by the end of June, and here we are at the end of June and still empty handed. UGH! We've been waiting sooooooo long! I just want to file my I129F ASAP, but especially before the new pricing structure goes into effect.

Any experiences that any of you would be willing to share, I'd be very grateful!

It took me 2-4 weeks I believe to get the decree absolute. I'm trying to find my papers to verify this, but I've filed the ones that were less important away - I'll keep looking.

Mine was 6 weeks after the nisi. I didn't have to do anything further and as long as there were no objections between the date of the nisi and 6 weeks after, it would become absolute. It just came in the post and we had no lawyer involved. This was back in 2002.

It was 6 weeks sorry! (It's been a loong time and a huge youthful error :P)

Referring to the decree made in this case on 3 March yada yada at yada yada between yada yada and yada yada

(important bit)

be dissolved unless sufficient cause be shown in the Court within six weeks from the making thereof why the said decree should not be made absolute, and no such cause having been shown, it is hereby certified that said decree was on the 18th of April made final and absolute

(so it took from 3 March to 18 April to become absolute after the previous decree)

(dunno if this is general English law or whatever, but it was Derby County Court)

Did your sweetie learn anything new today, julezabelle?

He FINALLY was able to talk to his solicitor this morning (she was in court all day yesterday). She said she was as surprised as he was that it wasn't yet resolved. UGH! She has supposedly been trying to contact opposing counsel, who never returns her calls. She is following up again today to try to get the case number from them and find out when she actually signed the Absolute and when it was filed in court. We should know something early next week, but he has asked her to email him today with any updates, as well. So, we'll see.

In the meantime, I am dying! The problem with sols is that nothing is urgent for them. You have to stay on top of them, or they'll just attend to other matters. I learned that the hard way with my own divorce. You must stay on top of things. After all, you're the only one who has a vested interest in getting this done. They just want to collect your money.

The sol should have the case number from the decree nisi - unless she misplaced that. But yes, I can see where she'd need to follow up and see if his ex actually applied for the absolute (as she claimed she would).

You're sure it isn't around, right? Tim managed to miss his a few times going through paperwork insisting it wasn't there since it's such a deceptively simple document.

This idea may not be the best or most preferable, but, if it seems like it will be a lot longer to get the decree, could you not still apply and just see if/when you get RFE-d for the proof of divorce? You have ample time to kill, right? (Wait, are you a lucky duck VT filer? Less time maybe :) )

Just a thought. Since the turn-around on RFEs isn't too slow, at least compared to the overall processing time (speaking as a CSC filer, anyway). Obviously, would be best to get it gone in one shot, but I know how frustrated you must be waiting!

Its definitely not a done deal. And sadlyhis sol is just not chasing it up for him as she should be. But our priorities are not her priorities. I keep telling the man, he needs to keep the pressure on her! As you know Daisy, the squeaky wheel gets the grease!

I have thought about mailing the I129F in w/o the Absolute, but am very hesitant to do it because I can't even enter a date in for end of marriage, ya know. Plus, I'm afraid it would trigger a flat out rejection, rather than an RFE. UGH!

Yes, I am going to file with VSC, but don't be too envious. They have a major slow down there too, more like 60 days now on NOA2...I know, I know, still better than the other BUT I have been waiting in other areas of life for so long now to make this happen, that I am desperate for a quick NOA2!!!!

I'm just going to wait to get the Absolute, as evrething else is ready to go pending that document. Fingers crossed that it is SOON!!!

I'd be afraid to send in the I 129f until you at least know for sure that the ex actually DID apply for the absolute.

Its one thing if 'oops!' you sent them the wrong divorce form (nisi versus absolute) - but possibly quite another if the subsequent absolute that you send in for the RFE is dated AFTER you sent off the I 129f.
