I-751 Removal of Condition Interview!!! 10yr!

Timeline

After applying for my husband’s 10yr visa in 2019, he just getting a letter back from uscis to come in for an interview. He changed his address with uscis  and he's been living in another state for almost a year! We been separated and living apart, but trying to find out if we going to work it out. I found out my husband cheated on me while we was together with a young girl from his old job. He is now being accused of being the father! I just found out all this last month in September about the baby and that he been still having the affair. Since being caught and the secrets is out the bag he claim to have cut the relationship off. Unexpectedly they are asking for an interview and I will not do anything but tell the truth and nothing but the truth! So I'm asking have anyone had experience with these interviews?

I would not attend the interview, his i-751 will be denied and his nightmare will come.

I was definitely thinking of not attending!!! I also was thinking of going and showing all the nasty videos, pictures, and baby photos that the other woman sent me! I just pray to God to guide me.

Just don’t tell him your intention. Affair is difficult to prove, he just says love change. But no show at interview will be more difficult for the dude.

We are in the same age group! 39 & 42 ....3 years difference.This is not and age difference problem, or a young immature boy, this is someone who wants their cake and eat it too! This is not an ugly woman who can't get a man problem...I'm very beautiful! I don't know what's HIS problem...all I know it is not mine anymore. I wish him the best.

He can get a divorce and do it on its own. It will delay his process but there were many ppl before him who got divorced even before the two year was up.and had no problems.

Whatever your religious belief, you need to turn the other cheek and move on. File divorce proceedings and don’t attend the interview. He can do an adjustment of status and you can both move on with your lives. There’s no need to be vindictive and nasty, that’s just stopping to his level, and makes you no better.

This is not an AOS. It is ROC. He will need to file a divorce waiver to proceed. That will be up to him. Not impossible, just a lot more involved for him.

It is up to you if you attend or not, if you don't attend the interview for his joint I751 petition to remove conditions the i751 petition will be denied. If you do attend the interview and indicate that you are not living together and are separated his petition will also be denied.

 

Unless you want to help his case and misrepresent the fact that you still live together as a married couple there no point for you to attend the interview.

 

It would be up to your spouse to change his i751 case to proceed without you, otherwise it will be denied.  

K1 Visa Arrived USA July 2017

Married August 2017

AOS Approved July 2018

 

Filed for i751 joint application May 2020

Fingerprints reused October 2020, and February 2021 and June 2021 (Yes 3 fingerprint notices)

Case move to National Benefits Center December 2020 for quicker processing from California Service Center

Oct 2021 out of processing time inquiry made, response May 5th 2022 that our i751 case will be addressed at our n400 interview

Combo interview May 16th 2022, in Sacramento

Approved June 08, 2022

 

Filed for Naturalization May 2021

Fingerprints reused May 2021

Combo interview May 16th 2022, in Sacramento, 

Approved June 08, 2022

Oath Ceremony completed June 29th 2022

DO not attend the interview, also do not provide him with any evidence that you have for a bonafide marriage.  You do not have to be divorced to remove his name from your bank accounts, utility bills, etc....

 

FYI, USCIS does not care about marital unhappiness or affairs, so the evidence from the other woman will not matter.  

 

You can write a letter to USCIS and inform them that you are no longer living together, and that he lives in another state.  Send the letter to the local office and to where you filed for ROC.  

Phase I - IV - Completed the Immigration Journey
