Hey VisaJourney folks,

 

I made a post a few days ago, as our AOS case status changed to RFE after the interview and we were curious as to what they may be looking for, but we got the letter and now know what they are requesting. The letter says USCIS records indicate that my wife elected not to be vaccinated when we applied for the K visa, and as a result we need to submit a complete Form I-693, Report of Medical Examination and Vaccination Record. The thing is though, she got all her vaccinations in Colombia before coming to the US, and we submitted her medical exam in the sealed envelope when we had our interview in Colombia. We even provided the AOS USCIS interviewer a copy of her vaccinations when we had our interview two weeks ago.

 

Does anyone know why they are asking for this again? Will she have to go get another medical exam? As I said, we submitted the original medical exam in the sealed envelope during our Colombia interview, so we can't just give them a copy of that.

Is it marked completed on DS 3025?

 

The officer probably made a mistake. Unfortunately since the RFE was already issued, I would just do the medical and send asap so she can get her green card.

 

Fighting with uscis might not be worth it.

Can you get another copy from the hospital or medical office that did the actual exam. You should know the date, and the name obviously. Not sure how well records are kept, but that might be an option. My wife was able to get a spare copy of the medical exam the next day just to have. We never needed it and filed AOS using the DS-3025 that was marked complete, and had no issues. Did you keep a copy of your AOS package that you filed? you may have the DS-3025 in there. If not, you might be stuck getting the I-693 done ( Around 300 US). might be a little less if you can prove vaccination records, or they may need to do a Titer Blood test to verify immunity.

Once you have copies of her records, you can call the Civil Surgeons in your area and find one who will update her records without doing an entire exam. Legally, they can do this, but some don't seem to be aware of it, so it's worth it to call ahead and ask.

At her port of entry into the United States she should have given the sealed I 693 envelope to a officer that checked her K1visa. At that point the officer should have opened the envelope and gave one of the copies to her. My wife just had her AOS interview and the officer at first didn't see that record in her file. I had her copy and when I was going to hand it to him, he found the original I 693 in the case file. You should always bring copies of everything that they ask for in the original filing.

Just a correction. There's no 693 for medicals abroad. 693 is used exclusively for medicals done inside the US. Doctor abroad use DS forms (like DS3025).

I was with my wife when we filled out the Medical exam paperwork in HCMC. She then proceeded to get the vaccinations that she needed and the doctor gave us the sealed envelope to turn at the port of entry, which was Dallas Tx. We also had to use a doctor that was approved by the Consulate just like you have to use appropriate doctors in the United States

What I'm saying is that the foreign doctor doesn't fill out a I-693. They fill out DS-2053, DS-3024, DS-3025, and DS-3026. Did you see what was inside the envelope? I saw all the forms my doctor filled out in Brazil, they were all DS forms.

Maybe a late reply, if not, I hope it helps.

 

Assuming that you have copies of the documents you sent for the aos, I´ll suggest to call them and explain that you did submit the document the´re requesting, once you do that sent the document again with a cover letter explaining you call on xxx date to request clarification, and you are re-submitting the document once again.

 

From my experience, I got a rfe requesting a co-sponsor, we called USCIS, long wait,  my husband talk to the agent on USCIS requesting clarification, because we did not need a co-sponsor, he asked them to review the documents we sent. We re-submit a copy of the original form with the cover letter. After that I received a notification on my USCIS, confirming we request a revision.  It´s an easy fix.

Sorry for the delayed reply all. Thanks for all your help and responses to my post! We ended up just getting my wife checked out by a civil surgeon and filing out the Form I-693. It was a little bit of extra money, but we figured it would be quicker to do that rather then trying to challenge the USCIS's decision. We submitted that, along with translations of vaccination documents my wife had from Colombia, and it is currently processing on the USCIS side. Fingers crossed they have everything they need now and we get her green card soon! 🤞
