Hi,

my case is Filed under F2A in 2017 by my husband, now we are waiting for the interview, but I’ve got an amazing proposal from a very huge company in USA, should I accept it? And go there for temporary period? Would they accept my petition? Are work visas under ban? Please help me out.

There is nothing in principle to stop you pursuing other visa options when you already have one in progress, assuming you meet the criteria for other visa types. Whether you will be approved and a visa can be issued under the current COVID restrictions is another matter.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

It’s not just COVID, the presidential proclamation of June banned most work visas until year end. Certainly, the two dual intent visas (H1B and L visas) are banned, as are J. (O visas are not easy to get at the drop of a hat at the best of times, are not suitable for many applicants, and are not dual intent so the F2A petition would be problematic - so O seems a very unlikely route. )

In any case, if @Sal11’s process is far enough along that all they are doing is waiting for interview, that would likely happen sooner than any work visa even if the bans do end at the end of the year.

But isn’t the work visa ban due to COVID? It’s to protect the American job market due to the high levels of unemployment here caused by shutdowns. That’s what I meant by “COVID restrictions”, not closed or limited-capacity embassies.

You would not apply for the work visa / the company would do that thru company lawyer (very costly for a company)

In normal times even this takes a long time

and now????

I misunderstood from the way you phrased it  “whether you will be approved” “if a visa can be issued” due to restrictions, it sounded to me like you meant embassy closures. As with the banned family categories, no interviews are being scheduled unless an exception to the proclamation. So it is not even close to getting to “whether will be approved” stage.

Go for it, there is no downside.

Most work visas are banned, yes.

What about visit visa? It’s a really great opportunity I don’t wanna miss it! :( and I’m a blogger, with huge following. So can I go for O category in this case?

You can’t work on a visit visa.

If your work is done on the Internet, why do you need to be in the US?
Please research about the requirements for O visa. You need much more evidence than just number of followers. Also, it doesn’t seem Pakistan is processing either B or O visas yet.  Neither visit nor O visa allow for immigrant intent so even if they were being processed it seems highly unlikely you would be issued one.
You are almost at the end of your journey, just have a little more patience.

Most unlikely, I would go for the huge company you mentioned.

These things take time and the situation currently will change.

O visas are for people with demonstrated, extraordinary achievements in certain fields.  Not that blogging isn't great, but it isn't something you would need to be in the US to do.
