Where is he traveling to imminently that he needs a passport in a pandemic? Is that wise that he travels now, given that you are about to have surgery and he will be caring for you? 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

A US passport is not necessary to get a new job, if he has a state ID or driver's license and an unrestricted SS card, he'll be fine without a passport.

I understand your frustration with the passport application process, but they prefer original documents per the instructions, and the certified copy option is at the discretion of the accepting agent (US postal worker).  As the passport evidence instructions state, "in some cases, you may be able to submit a certified copy..."  You could try another post office or qualified acceptance agency and try to convince them, but if they say original documents only, they can require originals.  I'm not sure that the idea to sue the US Government over this would be worth your time, money, stress... but I agree with you that sending a complaint to your US congress persons might be the best way to try and fix it for future applicants.

You stand a better chance of winning the powerball than having your passport and certificate lost in the mail. Does it happen, sure, but no where near as often as I think you believe.

He isn't traveling but it is highly recommended with his citizenship to obtain a passport. Passports are also easier once obtained to replace if lost so it is preferable to show that as proof of citizenship rather the the naturalization documents upon hire. On the flip side of that we have been separated from his family for years now and unable to travel internationally (He always gets detained at the border so we don't do that)....we may not be traveling any time soon but we have waited long enough to even feel like that could be a possibility for us. He needs to see his mom at some point. Its been over 4 years since he has visited with them.

But a passport isn’t necessary for a job. He can show his overseas passport or his state drivers license to confirm identity and his unrestricted SSN card to show work eligibility. Yes a passport is “easier” as it covers both identity and work eligibility but it’s not necessary. Many US citizens don’t have passports. That’s why there are various documents you can submit to an employer to satisfy the I-9 requirements.

If you're suing the US government for causing you to have "lost wages," an expensive legal team isn't really in the cards.
