Do not confuse USCIS (a DHS agency) with the Department of State (DOS).  Separate agencies, different injunctions.  DS-5540 is a DOS form.  The injunction against the DOS policy involving the requirement for DS-5540 is still in effect.  Please refer to the DOS website for updates regarding DS-5540.

 

The link you provided relates to USCIS policy involving the requirement for form I-944 from those who are adjusting status within the US.  Since you are doing consular processing, I-944 is not required from you.
