Like you said adjusted gross income on tax return is only for self employed and regular employment the consul officer would look at

current income on Paystub

 

 

if the adjusted gross income is only for self employed why did even sumbit tax return on Ceac ? 

 My joint sponsor isnt self employed

Where can i find out the current income of my joint sponsor ? Is it anywhere on tax return or W2 ?

Because latest tax transcript or tax return is a requirement at NVC stage for all sponsors who need to file taxes, whether regularly employed or self-employed.

 

Also, income reported on the tax return must be listed in the I-864, part 6, item 24.  For those who filed IRS forms 1040 and 1040A, the line for Total Income should be used.  For those who filed IRS form 1040EZ, the line for Adjusted Gross Income should be used.

So my joint sponsor who isnt self employed got nothing to do with adjusted gross income.. I’ve been looking at ajusted gross income and driving myself crazy that its less 😅 only about 23,000. I was on the stage of finding another sponsor. Thank youu so much !

From the info you've shared, your joint sponsor's household size is at least 4.  So their current income should be at least around $33,000 to qualify.  Note that just meeting the minimum doesn't mean that you're in the clear.  The consul officer will decide based on the overall circumstances of the case.  If your joint sponsor's current income is barely above the threshold, you might still be asked to find a different sponsor.

My joint sponsor has income of $35,000.00 . 
i checked the affidavit of support my lawyer filed out today!! Is that good ?

 

and for some reason my lawyer didnt include the spouse of joint sponsor in household since they dont have us citizen or has a greencard. And that affidavit was from 2018 when they didnt have a baby too so the household is 2 people !! And even if it is 4 or the consular officer says 4 still 35,000 is good right ?

 

 

 

one more quick question - the affidavit was sumbitted 8 Jan 2020 and accepted 14 Feb 2020.. but i saw the affidavit got expired on March 31 2020. Will this create any problem on the interview? On why its expired

If your joint sponsor is currently married, their spouse must be counted as part of the household in the I-864, part 5, item 3, regardless of the legal status of the spouse.

 

That affidavit of support from 2018 would not match the information in the joint sponsor's 2019 tax filing.  Request an updated I-864 from your joint sponsor and bring to the interview.

 

$35,000 for a household of 4 meets the minimum requirement for consideration, but the final decision is still with the consul officer.

Really an updated affidavit of support ? I never heard anyone take that though. They would just take new finicial papers.  Like 2019 Tax and all.

 

They got married at the end of December literally maybe thats why the lawyer didnt count .

 

but are you suggesting a new affidavit because that old one doesnt have the baby and spouse counted in . Or because its expired now?

 

Because it expired 3 months later after sumbitting..
