Hello.  212(a)(5) is for labor certification.  It would not normally apply for a IR1 visa case.  Are you sure that is the reason?  Did they state something specific, like 212(a)(6)(C) - misrepresentation or 212(a)(4) - public charge?

yes iam sure,i had refusal visa ir1,ambassy gave me white paper

I am not questioning that you applied for the IR1 visa.  I am questioning the reason for the denial.  They might have checked off the wrong box by mistake.  Did they verbally tell you a reason, such as they think you might become a public charge or they found conflicting information in what you submitted?

Regardless, it seems they just gave you a generic reason for denying your visa application.  Your spouse visa petition (I-130) will be returned to NVC and probably back to USCIS.  It will take a few months for you to hear back from them.

 

What happened at the interview?  Did they think your relationship was not genuine?  Are there any issues with you or your USC spouse's background, like a previou marriage that was not properly terminated, or terminated after the I-130 application date?

Very odd as that reason indicates you were not qualified for a work 

it will take 6 months to see any results and your spouse to hear why denied in detail

the USC will receive either a NOIR or NOID and be given a period of time to provide evidence that what the CO says is not right

her response must be in the form of real evidence not just a statement

the interview was good,i show to ambassy some approvals like photos of mariage and discussion f boook ....

my wife she is divorced
