Hi guys! Hope everyone is fine and thanks for reading!!!

I am looking for some advice about my i751 jointly petition case that already started the 90 days window. I talked to some lawyers in the last weeks and even when some of them told me i could do it myself I'm still doubting. Mostly because we don't have any assets together because we are a young couple, not doing much money on our jobs while living with mother in law, we all share the housing expenses and the car is on my husband's name because he thought it wasn't convinient to get a loan with me because i had zero credit at the moment i was just arrived from my home country to live here. Then when he took me to open my banks accounts to the same banks than him he didn't want a jointly account because he is used to have control of his money and he didn't feel comfortable doing that. I understood and now seems to be a problem. So i just opened a jointly account and started using it with both debit cards and expected to wait until the first statement arrive in the mail and then submit the package. Ohh and by the way the only taxes we filed was this year and it's not even processed yet so no tax return just F1040 :(

My mother in law signed and notarized an affidavit explaining how we split the rent and bills. And that all bills are on her name except for one that is on my husband's. Not even in the same cell phone bill because it's prepaid.

So i have around 300 pages and this is the list of all my documents and i think it's all i have. I'm just about to hire a lawyer i can afford but i feel i just did most of the work. I need to write the cover letter and print the forms mostly to be done.

Please let me your thoughts. I will appreciate it. Thanks again!!

You definitely don't need a lawyer for now, there is not much a lawyer can help you with, it's a very straightforward application. Note that for ROC, the immigrant is both the petitioner and the beneficiary. Your spouse just signs the petition. You don't need birth certificates, passports or pay stubs, definitely not W2s, your marriage certificate is also unnecessary. 

 

It looks like you have a lot of fluff, I don't think it will hurt to send it but I don't know if it will be helpful. I'd cut down on some of the mail. Do your driver's licenses have the same address? 

 

I wouldn't include chats or Facebook stuff, but it's up to you.

I don't see a big danger if you include too much stuff. So there's no point point in using a lawyer unless you appear before an immigration judge but that's highly unlikely. 

 

I'd organize your evidence in a way that makes it clear what you're using it for. Maybe write a cover letter and list all the things you're using for proof of living together. Explain how you combine finances and how the evidence you have supports that. Make it easy for them to understand what you're trying to tell them. 

 

You will likely have an interview because you came on a spousal visa, so continue to gather evidence.
