Not an issue if you didn't pay US taxes as long as you didn't owe any taxes. But if you also mean you haven't filed US taxes since 2017 then that is a big problem. You will not be able to prove that you meet the support requirements without filing your US taxes. I recommend doing so immediately. You will have to prove that your income is above the US poverty line.

You cannot "change" someone's age.  It isn't like gender or hair color or name.

 

That type of fraud (counterfeiting documents) is exactly why people from high-risk African countries (rightly) get denied.

That makes no sense.  Your entire story sounds sketch.  I'd be very surprised if she gets a visa.

I personally find this whole story unbelievable. You cannot lie to get a visa. You won’t get anyone here tell you that it’s ok. End of story.

Before you leave Comoros you need to get the bonafides together for your petition.  You do not need to include a statement from your doctor.

 

You need to have a string front loaded petition.

 

It is clear that you didn't understand the IRS rules or even read the line in your passport reminding you to file a tax return.  Even if you are not earning you should file a tax return.  You will need to explain that on your I-864 at the NVC stage.  You will need to show you are earning income in excess of 125% of the amount in I-864P.

 

The NVC will note her documents are new including a late registered birth certificate.  You will need to have to returned to the US by this step.  It will take a while to get to this step and you will be able to show current earnings.   Another option is to remain in Comoros and show that you will re-establish domicile.   If you do that you for sure will need a joint sponsor.

 

The consulate will do a background check, review all the documents and  your financial situation.

 

I'd recommend you use an family immigration attorney, familiar with sub saharan Africa, to review everything once you get back to the US prior to submitting the I-130/I-130A.

 

 

 

 

 

 

She hasn't applied for for a DV visa, she entered the lottery. It's not legally binding

I think OP can deal with the situation by getting the record straight (i.e. getting the correct birth date documents for his wife fixed) and by working on bonafide stuff while earning his income in the US.

Yes, I don't see why people are accusing OP of fraud when he had nothing to do with his wife's wrong records. His wife needs to get all her documents fixed but it's not like OP planned for this mess.
