You have a filing obligation.   Whether you have a tax liability is a separate question.  US want you to report your worldwide income

But I don't work here because I have a problem with my back. I have a hernia discal so like I was alone in US with no family I decided to come back home and do traditional treatments. so I don't have income to report. The doctor here give me a certificate

Then you need to  explain this to the consulate.   You will need a source of income to sponsor your spouse

YMMV

I am going back and i will find a job , after getting the job I will be the sponsor of my wife . I think I don't need a sponsor if I have a job. isn't?

You don't need a sponsor cuz you are a citizen.   Whether you are a qualified sponsor for your spouse is another question.

YMMV

Thank you a lot for your help. but do you think that I have to put the doctor's certificate that i was sick in my spouse's application?

Read the petition instructions carefully.  Provide what they require.

They don't care the reasons why you haven't been in the country.

YMMV

So we should just leave her age that she have now in passport and diploma because someone told me here that USCIS won't deny because we have a different age

How about this for an idea...

have all her documents showing her REAL age, name and everything else, rather than provide fraudulent, false or altered documents...

They said they won’t deny because of you being older than your wife.

You wife having documents that say she is a different age to what she actually is they will deny her for - even if a judge signed off on it in her country based on her parents lying. They do background checks and will find out about the amended birth certificates and other documents. They will ask why and if they determine that she really is older than her new documents say then she will be in trouble.

What did she put on the diversity visa application - if she put an age she knows to be false or if she put single when she was already married to you then it will end badly.

Begs the question - If she and her family can lie about this then what else are they lying about?

How did you meet her? Married after meeting two months previously and with such a sketchy backstory, I don’t know man I would have run a million miles.

Way way way to many variables for me...

19 but 23.. mom altered birth certificates, meaning false passports obtained with it... potentially fraudulent diploma... married 2 months ago after meeting.... the whole “WE gave her a new birth certificate” Should we change it again.... Not to mention tax issues...

for all we know you could have married your sister based on everything you’ve said

my recommendations...

if you give the dept of immigration any information or documentation other than what is 100% true and 100% authentically issued, then you deserve to have your visa denied and her be banned for life due to misrepresentation of the truth..

You’ve already said it shows an untrue age of 19 years old... you said you know that she is 23 and that her age was changed on her birth certificate..

this is fraud and misrepresentation of the truth and illegal for you to do

come on man, I was not planning to lie. I said that when she was young , age 10 like that, her parent change her age. I mean her parent reduced her age to 4 years. her real age suppose to be 23 now but since 10 years she use the age that her parent reduced  now she have 19 years so I thought to use her real age but this one she have today.
