Help with co-sponsor (split)

Your sister's income was never enough.  Her household count was three before the baby; herself, her husband, and the intending immigrant.  $22k would not have been enough.  Now with the baby, her household count is 4.

There was no need for any financial information or forms when you filed the petition.

 

NOW, have your sister or her husband act as the joint sponsor and the other combines income with the joint sponsor in order to qualify.  I-864 from joint sponsor, and I-864a from household member.  This will work, provided they meet the requirements for a household of 4, the two of them, their child, and your husband.  Do both have at LPR status or US Citizenship?

Because you failed to count her husband in her household.  You made that mistake, not NVC.

The NVC does not approve anything.  They merely collect paperwork.  Only the US Embassy can make the determination if the Joint Sponsor qualifies.

Here is the bottom line.

 

You can not combine your income with your sister since the two of you do not live together.

 

You will need to file an I-864 as the petitioner even though your income is low. 

 

Your sister can be your Joint Sponsor and must file her own I-864.  Your sister's household count will be 4; herself, her husband, her baby, and the intending immigrant.  She can combine income with her husband if he files an I-864a.

The US Embassy will want 2019 tax returns from you, your sister, and your sister's husband.  You can get a head start by correcting your filing mistakes and include the proper tax returns.

Thank you so much ..  Yes i filed an l-864 also.

 

My lawyer did all this process for me.

 

One last question if my bro in law isnt USC or greencard holder would it just be better to add a new joint sponsor before the interview ?

Since i cant do my sisters husband he isnt an usc or greencard holder .

 

Can i have 2 joint sponsors ? .. 2 different joint sponsors ? Would that help? Fill out another l-864 and upload documents to ceac of new joint sponsor before the interview?

Your sister's husband can not file the I-864a since he is neither a USC or a green card holder.  Since your sister's husband can not be her household member, your sister will not qualify to be your Joint Sponsor.  

 

You need to find a new Joint Sponsor who qualifies.  You can not have two Joint Sponsors.  You can only have one Joint Sponsor.  The Joint Sponsor can combine income with his or her spouse.  Both of them must be US citizens or green card holders.   Best to do this as soon as possible before your husband's interview.

After finding the new joint sponsor do i need to upload everything on CEAC to be reviewed by nvc? I am documentarily qualified right now. Or just send all the paperwork to applicant to bring it with him to the interview.. ?

Thank you so much.. one last question uploading it on ceac will i have to wait for NVC to approve them again? To review them again? Or will the embssy consular officer be able to see them only? .. Because i am already documentarily qualified. I dont wanna wait to be documentarily qualified again thank you for your time.
