Currently at the NVC stage. We got a reply from NVC saying my wife doesn’t meet the requirements to bring me the the states. She has been working since 2017 and this particular Job doesn’t require her to file taxes. She makes. $58k yearly. Now our lawyer wants her to file for  co-sponsor, when I know the minimum income to bring me there is $21,550k which she makes  way more than. Before this feed back from NVC we explained and notarized a document stating why she doesn’t file taxes. Sent her monthly payments . I am shocked at the moment . Because, just lawyer fees alone are soo expensive.. any advice please????

If she is earning $58k yearly, then she is required to file a US tax return.

Can you explain the exact reason she is not required to file a tax return? Then somebody might be able to give you more help. Right now it is too vague to understand her circumstance.

What her job requires or not is irrelevant to the IRS.  If she makes that much, the IRS law is clear, if she made more than $24,400 in 2019 she is required by law to file (married jointly, if she files as married separately it is more than $5).  US Immigration did not accept the statement that she "doesn't have to file taxes" because she does.  So to fix this she will have to file tax returns with the IRS, at least for the most recent tax year (2019) then submit those tax returns or an IRS tax transcript, to NVC, if you want a visa.

What job does she have that she doesn’t have to file taxes?
