Man accidentally divorces his wife while he's asleep

A similar incident, also in India, with a positive court-imposed outcome:

NEW DELHI: The Supreme Court on Friday directed the Orissa Government to provide police protection to a Muslim couple who were forced to separate after local clerics issued a Fatwa that they were divorced even as they wanted to live together.

The husband of Petitioner Nazma Biwi had pronounced triple talaq in an inebriated condition in 2004 but later realizing his mistake, he decided to live with his wife and three children.

However, local clerics at Bhadrak issued a Fatwa that they were divorced and hence could not live together. Thereafter the couple was forced to live separately by the community.

"No one can force them to live separately. This is a secular country. All communities---Hindus or Muslims should behave in civilised manner", a Bench of Justice Ruma Pal, Justice C K Thakker and Justice Markandey Katju observed.

According to "The Koran for Dummies", if a man wishes to divorce his wife, he must say "I divorce you" three times to his wife before 4 muslim witnesses. Then the wife must agree to the divorce, at which time they are separated for 4 months to determine if the wife is pregnant (in which case arrangements must be made for the care of the new baby). After this period, the couple is brought together again and asked if they still wish to divorce, if they do, the imam declares them divorced and that's that.

Did I post this before? Anyway, clearly this did not occur; he did not say "I divorce you" before 4 muslim witnesses, and the wife did not agree to the divorce.

These muslim "clerics" probably haven't ever read the Koran, nor do they have any understanding of it. They are hardly fit to be muslims, let alone lead prayers.

also, since etoh/drunkness is not condoned it should have been a moot point...

just a bunch of backward chopf##ks asshats making a decison based on their distorted village beliefs...

An Imam is simply the person who leads the daily prayers. They're suppose to be the person with the most knowledge of the fiqh (jurisprudence) of prayer, or someone who knows a lot of Qur'an. In the United States, the term Imam has become a little something more, in that they often are called on the deal with the spiritual and social issues of their local community.

A scholar is different. They've studied a wider variety of subjects and usually should have the right to teach bestowed on them by an elder, respected scholar. (eta - scholars can be known by many different names depending on tradition - Shaykh, Mullah, Ayatollah etc) Scholars may also be imams if they lead prayers, but not all imams are scholars :) My husband is occasionally the imam at the local mosque, but he's far from being a scholar.

It would be interesting to see what legal reasoning is behind the fatwa. They're probably deobandi hanafis, who use a lot of analogy in their fiqh.

But, this is definately a reason to go easy on the alcohol. People do stupid things when they're drunk.

Yup. One is not allowed to make salat when drunk, because their intentions are clouded. I can't imagine how divorce would be legally binding when drunk when salat isn't.

Is this story for real? Don't you have to have the intention of divorce to actually proclaim talaq? And that's bull that she would have to marry another man and divorce him before she could remarry her husband unless this is the third time he's already divorced her and remarried her. And if this is the third time he's done it so far WHY does she love him so much???? I think this article is full of poo! :P
