Do we need to worry about our overseas gay marriage because Amy Coney Barett?

Year 2020 seems like a very hard year for us.

My partner is stuck in America because he has better lives in America.
While , I am stuck in New Zealand because migrant cannot come back to NZ because pandemic.

 

And Amy Coney Barett becomes supreme court, and I heard that same sex marriage will be erased.

Our case has reached NVC and waiting to be DQ.

We are worried what will happen to our case, if Trump win and Supreme Court revert their decision in same sex marriage?
Is our case will be nullified because of the supreme Court Decision?
At this moment I have not seen my husband for almost 1 year, and we really miss each other.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Is there a chance that with a strong conservative majority on the US Supreme Court now, that the 2015 Obergefell case legalizing same-sex marriage in every state could be overturned in the future?  Sure, it is possible, but unlikely in the short term as the legal process takes a very long time, months and years to work through lower courts all the way up to the SCOTUS.  The current focus of the court is on voting processes and the ACA, not Obergefell.  My advice is to try not to worry about it, all that would do is add stress to your life.  And be prepared for a worst case scenario if Obergefell is overturned in the years ahead.  NZ is a beautiful country.  Canada, Brazil, in fact most developed countries would be a possibility.  Even if the court overturned Obergefell, it would be unlikely that they would take away anyone's LPR or US citizenship status, imagine the chaos if they tried to do that!  So move forward with your spousal visa application and hope for the best, and good luck!

So,  it would be a gay couple to bring a lawsuit against the state (to divorce) on the grounds the marriage should not have been sanctioned by the state?

We are talking about the new girl, not the old dude. Yes those opposing her will say anything to sway the vote. Abortion is another issue that they are afraid will be overturned but hasn't.

We have had quite a few same sex couples, if anything they seem to have an easier path, and I do not see that changing anytime.

I even found a site that had gay couples against gay marriages

 

this is one decision i have not followed closely but i do know conservatives (even not associated with a church) marched in protest 

 

and i am so happy i don't have to make these decisions

Well, it hasn't happened yet, but you can predict that will be the case unless Democrats win this thing. As much as people say we should not bring politics, it affects our lives. And from what we have learned the last 4 years, nothing is off the table
