I-130 approved....can I abandon the I-129F???

You can abandon the I-129F by sendind a letter to the consulate telling them that you are pushing you I-130 through to replace the K3. Then you will have to notify USCIS that you would like to pursue the CR1 and you have to pay a FEE for them to forward your I-130 to the NVC. They will require a form for you to fill out as well as the fee.

This is a letter I recently got from the Sydney Consulate:

We will need to have received the approved I-130 petition to be able to

process his application for an immigrant visa. When I-130 petitions are

approved, they are forwarded to the National Visa Center (NVC) in

Portsmouth, New Hampshire. Should you wish you may contact NVC directly

to inquire as to the status of your I-130 and request that it be

forwarded to Sydney for processing in lieu of the I-129F application we

have already received.

Our records indicate that your husband has been scheduled for his final

visa interview for July 3, 2007 at 8:00 a.m. The appointment package

will be mailed to him on Monday, June 25.

MY I-130 GOT APPROVED FIRST....i-129f IS STILL PENDING

Congratulations on the approval. If you want to cancel I-129F, simply write to the service center where they have your I-129F petition and ask them to cancel it. You may mention that since your I-130 is approved ahead of I-129F, you only want to pursue the I-130.

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

You don't have to do anything. Actually, doing something right now could delay the process. First, you need to wait a couple days to see if your I129F also gets approved. If it is not approved, then your I130 will be sent to the NVC. Then you will have the choice of either going with the CR1 visa or K3 visa. If you want to go with CR1, then you follow the instruction sent to you by the NVC. You don't have to stop the I129F process. It has nothing to do with CR-1 visa or the I130 petition.

Congratulations on the approval. If you want to cancel I-129F, simply write to NBC and ask them to cancel it. You may mention that since your I-130 is approved ahead of I-129F, you only want to pursue the I-130.

I have read your received responses several times and you may not be receiving enough information to make a decision.

First you are unclear about which approval you received...USCIS or NVC. If you have received you approval from USCIS, as your timeline indicates, the process at the NVC will still take a few more months. If you have received approval from NVC then you have a great choice and cancelling the K-3 has many benefits. If your only interest is "time" and not money then choosing to pursue the K-3 will definitely put you both together very soon. However after being in the US you will file for an Adjustment of Status and you case will go to immigration for processing. Because it is almost July remember the new fees take effect 30 July and your fee will increase to $1050 for the immigrant visa. If the money is not a problem...the get yourselves together and enjoy life while changing your status together instead of thousands of miles apart.

I agree with "waiting forever" as well. We have both visa options in process and they are very close to each other and neither has slowed or stalled.

Actually doing something would not delay the process. Where did get the information that doing something could delay the process? The approved I-130 will go to NVC regardless of what happens to I-129F.

Oh for goodness sake, just wait for the NVC to sends you the documents, send them back and they will know that you are going to pursue the CR1.. the worst thing that can happen is that your K3 may come through later and by then you would already be near done and going to your interview for the CR1... just don't respond to the K3 paperwork and wahlah... this is not that hard

I agree with you. The OP can choose not to respond the I-129F correspondence. But in my opinion, it is better to inform the appropriate service center (where the I-129F petition is currently) that I-129F process won't be pursued, as I-130 is already approved and it is worth concentrating on one process.

I agree with you and also stated that in my first post, but obviously it is not simple enough to understand. Either way, doing both is not bad either. I know because I have done both. nevertheless if he wants the CR1 and it has been approved first, then that will be the first packet he receives. If he turns that paperwork in, then by the time he gets the packet for his K3... he will already be set for the interview for the CR1. If you do not respond to part on of the DS-230 for the I-129F then nothing will happen. I am trying to make this as simple as I can without causing Ron123 any more of a headache

Oh yes, I agree with you. I was emphasizing on notifying the appropriate USCIS service center that I-129F won't be pursued, as it would make it official from the petitioner. As you said, of course the OP can pursue both I-130 and I-129F for the time being.
