Anyone can request an expedite - no law against that. Having your request approved is another matter. I don’t see that your situation (from what you have described) would qualify for an expedite but no harm in trying.

Anyone can ask for their case to be expedited but must follow certain criteria. https://www.uscis.gov/forms/expedite-criteria  If accepted or denied neither have an impact on any other process toward a visa. 

 

  1. For USCIS refer to https://www.uscis.gov/forms/forms-information/how-make-expedite-request
  2. For NVC they expedite K-1 visas already.
  3. For Embassies, An expedited request requires you to contact them either through email or a phone call. Most embassy don't grant expedited visas but only in the case of an emergency. Check with your embassy for additional details.

 

 

Chapter 5 - Requests to Expedite Applications or Petitions

 

Benefit requestors may request USCIS to expedite the adjudication of their applications or petitions. USCIS considers all expedite requests on a case-by-case basis and generally requires documentation to support such requests. The decision to grant or deny an expedite request is within the sole discretion of USCIS.

I am a big proponent of expediting but you do need a good reason to succeed..

I’m trying to go down this road. Because the State Department issued an advisory for Americans not to travel to Colombia, because my fiance and I have a son, both are in Colombia, and that our son might need surgery, I’ve requested an expedited K1. The embassy in Bogota can’t do anything because our case is not there yet, it’s still at the NVC. Waiting for the email from the NVC

Theoretically,  the parent of a USC minor child could be considered for an expedite

Expedite timing is an unknown, probably best to get him on a plane now.

I’m in contact with another member here who was granted an expedited appointment, and the visa was approved, because of the same reason, the petitioner and beneficiary have a son in Colombia as well.

Go for it but do not delay your child obtaining treatment

Just received the following response from the NVC:

 

Dear Sir: 

 

At this time, due to COVID-19 concerns, all U.S. Embassies and Consulate Generals have suspended routine visa services.  The NVC will not forward K-1 petitions to the appropriate U.S. Embassy or Consulate General until they resume routine visa services.  Routine visa services will resume as soon as possible, but we cannot provide a specific date.

 

Unfortunately, due to the closure of the U.S. Embassies and Consulates, we cannot send an expedite request for the case to the appropriate U.S. Embassy.

 

 

IMPORTANT:

Do not let more than one year pass without contacting the NVC concerning this visa petition. If a period of one year passes from the last date of contact (by telephone, mail, or e-mail) with the NVC, all submitted fees and documents expire. If this occurs, the fees must be paid again and documents must be resubmitted in order to continue the immigration process.

So there's no way to request an expedite to move from the NVC to embassy and get an interview?

 

I was curious about this process as my fiance's country is entering a civil war and that would maybe count for "urgent humanitarian reasons." Our petition has been sitting at NVC for 6 months now.

An expedite is an ask. All you are doing is kindly asking and hoping they will agree. Immigration agencies have no obligation to offer any expedite to anyone. So there is nothing more you can do. You can't force them to speed up you case. With everything that is going on in the world expedites seem to be at an all time high. People are getting extremely impatient and we have seen some very frivolous reasons to expedite on here (one person wanted to expedite for kid's birthday party).

 

So with requests being flooded in,  it is not surprising that more expedite request are getting denied.

The basis of an expedite is subjective so is its adjudication.

 

Should there be a situation where the Consulate has to close interviews will be geld elsewhere.
