I'm not sure if this is the right place to ask this question but... I'm Canadian and our I130 has just been approved!! Got the NVC welcome letter and now we're putting together our civil documents. I have changed my name and  I have changed everything except my passport. Due to COVID they shut down passport services and just reopened but for mail in service only. I want to submit everything as quick as we can. I have scanned my passport with my maiden name. The question is do I need my passport in my new name to submit off to the NVC or would it be okay to send my current passport and bring my new passport with me to the interview when that happens?

Yes - you can change it at the interview.   That is what we did.   Mary got her new passport a few weeks before the interview.

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Thank you! Did you apply in her maiden name or married? I've applied for everything in my married name. We are reviewing the sample DS-260 now to get ready and it says "the data on this page must match your travel documents." It says "enter all surnames as listed on your passport" since my married name is not yet listed on my passport... did you enter her name as it was on her passport or would i put it as married name because by the interview process it will be listed as my married name? I will be uploading the scan of my passport which will be in my maiden name. Not sure if we're overthinking it but I don't want to cause us any problems or delays!! Ps I have also done legal name change and will be sumbitting that too so this is the only document that would be in my maiden name.

In her maiden name since she only had her passport and our marriage certificate.  We didn't think that we were going to get her passport back so fast.   It just happened my mom wanted go to Mexico City and my wife could do her fingerprints for the PCC at the Filipino consulate.  That trip my wife also got her VISA for Canada. ;)

 

Match the DS-260 to the name on your passport.  Your married name is "another name used".

Just do everything left in the process in the passport name that you have on hand come time to do the DS-260.   It was no issue at all to change it at the consulate.   She took both passports to the biometric and medical and all they wanted to see was the one that matched the DS-260.   The next day at the document check they put a big sticky note on the new passport and the paperwork that essentially reminded the CO to make the change.  It probably added a minute to the whole process.  The CO was more curious about how/why she had a Mexican Permanent Resident Visa and if we went to Mount Everest on our trip to Nepal.

 

Don't worry about it.   The good news is that doing the visa in the new passport means you don't have to pay the fee to change the green card name.

Thank you for the response! Can I just confirm- did you apply for the I-130 in her maiden or married name? I applied in my married name.

Maiden - but that doesn't really matter.   The VISA is always issued in the matching Passport Name.

It doesnt matter if you sent the petition with married or maiden name.  The ds-260 will have maiden name as your passport currently has maiden name. 

 

You can take your new passport and old passport to interview to update and have the visa placed in new passport. It's smart to do this as your greencard will be in visa name and visa is in passport name.
