We received our first RFE which included a request to provide more substantial evidence of our meeting in the past two years.  I think we screwed up and didn’t do a thorough enough job the first time.  We included airline itineraries but not always the boarding passes.  We didn’t include passport stamps.  We relied too heavily on photo evidence.  We’re going to do better this time.  A couple of questions arose as we were going through this though:

 

1) Do we need to provide translations of visas in our passports if we provide them as evidence?

2) Will they be interested in evidence of meeting since the date of our application?  Or should we stick with only the two years prior to the application?

3) They mentioned in the RFE that we should include a duplicate copy of the evidence if we are requesting consular notification.  What does this mean and should we include duplicate copies with the response?

 

We would appreciate if anyone has any insight they could share.

Hello!  I cannot speak to all of your questions, but with regard to timing of evidence, they want to verify that you meet the requirement of having met in person in the two years prior to applying for the K1.  So, submitting evidence that you have met since sending off you application wouldn't do you any good.  

We got the same RFE back then, and we just provided passport stamps and boarding passes as "additional evidence".  I had submitted a copy of my I-94 showing all the trips I had taken to the U.S. to see my then-fiancée, but they still wanted to see the stamps in my passport.  After submitting that, our petition was approved within 2 weeks.

It's an urban legend that photos are quality evidence when they are not.   

 

The best evidence is boarding passes,  entry stamps, anything that you can tie to a date and a name.  

 

Any evidence provided to the USCIS that is not in English requires an English translation

1) Do we need to provide translations of visas in our passports if we provide them as evidence? USCIS requires all documents that you submit have a translation to English. If you are proficient in both languages, you can do this yourself. [see below]

 

2) Will they be interested in evidence of meeting since the date of our application?  Or should we stick with only the two years prior to the application? They are only interested in meetings prior to the submission of your I-129f, Petition for Alien Fiancé(e). Save the other meeting evidence for the interview which may or may not be asked for.

 

3) They mentioned in the RFE that we should include a duplicate copy of the evidence if we are requesting consular notification.  What does this mean, and should we include duplicate copies with the response? The duplicate copy notification has nothing to do with your current application as that applies to a consular processing and you are not at that stage being that your application is still pending approval by USCIS.

11.3 Foreign Language Documents and Translations.

 

(a) Document Translations.

 

All documents submitted in support of an application or petition must include complete translation into English. In addition, there must be a certification from the translator indicating that the translation is complete and accurate and attesting to his or her competence as a translator. See 8 CFR 103.2(b)(3) .

 

Just put this statement on it and sign:

Submit copies of your boarding passes and passport stamps.  You do not need to translate the entry/exit stamps in your passport, assuming they look like this:

Only submit evidence prior to your K1 petition.  Save the evidence of your ongoing relationship for your fiance to present to the CO at the embassy interview.

 

I am not sure about the part regarding consular notification.  Perhaps send duplicate copies just in case.
