My question is that I only have 2020 IRS to give for AOS for my wife.

 

I dont meet income 2019 and below IRS tax years.

 

But for 2020 this years income is more than enough.

 

Can I just submit 2020 IRS transcript with my w2s when I file January next year?

If I need a household co sponsor, can I use my mom? She is retired, but do they combined our income since we live in the same household?

Not possible. Tax returns for 2020 are not due until April 15, 2021

Provide tax returns for tax years 2018, 2019, 2020 including all 1099s and W2s.

You will need the last 3 years of taxes. Not just 1 year

I cant get a joint sponsor.

Just got NOA2. How do I postphone the NVC stage so that I dont have to repetition again?

 

Lol, my daughter who has CRBA will be 4 years old by then before coming in the US, since her mom is the down being petitioned.

I think you can wait the time you want (maybe someone with more experience can answer you better) but let me ask you that.

Did you filled your taxes in 2018,2019? Why don't used?

Yes, maybe you didn't get enough money than but you have now, right?

When we filled my husband had 2017 5k, 2018 14k, 2019 65k and we where approved. 

 

Do you have any savings? Or other things?

Not correct.  Only previous year's tax return in required.  The other 2 years are required.

You do have to state "Yes" or "No" to the question that asks if you filed tax returns for the previous 3 years.  If you state "No",  as in your case, then you have to explain why you didn't file.  You can explain that your income for 2018 and 2019 did not meet filing requirements.

Hi Maam,

 

      Yes I did not work 2017, 2018. So no income.

 

2019 income is 28k

 

2020 income will be 29k roughly.

 

I only have like 15k savings.

 

I was thinking just to work for another two years and do OTs to bring it up to 30-34k a year.

 

I just started working in healthcare.

than you need a cosponsor. yes you can use mom, dad or cousin brother or cousin sister or third cousin  as long they sign on the paperwork and take financial responsibility

You can automatically postpone at the NVC stage simply by not submitting the required documents.  If you do postpone, you need to inform NVC once a year to let them know you want your case to remain active (that you have not abandoned it).

 

But you do not have to wait that long.  File your taxes in Jan or Feb, 2021.   Submit a copy of your completed and signed 1040 as well as copies of all relavent W2s and 1099s.   Remember to file as married filing separately, or married filing jointly with ITIN form (W7).  Fastest would be married filing separately, but your may get better tax refunds as married filing jointly.

Under 23A,

 

   It only says most recent year.

 

I dont have 2017 and 2018. I will just let them know I didnt meet the income requirement for those years?

I will wait for my 2020 IRS transcript and W2 as well.

 

I have enough income for 2019 and 2020.

 

Its just everyone keep telling me that I need joint sponsor if I dont have ALL three recent tax years like 2017 and 2018.

 

I am little bit down.

You should still have filed 2019 taxes.  That is enough submit AOS for your spouse now, this year.  You do not need 3 years of tax returns.  Chances of the CO approving your wife's visa is greater if you show a steady history of income, but that is not the only criteria.

 

When you submit your AOS to NVC, the NVC may state that you do not meet income requirements.  If they send you such a message, then find a joint sponsor .

You previously said that in 2020 you will have enough income. Excellent. So in January 1-April 15 2020, you file your 2020 taxes. You have time between now and then to file your 2019 and 2018 taxes.  It does not matter if you didn't earn enough to require filing. It is easier to file for 2019 and 2018 than it is to prove that you didn't need to file.

 

So you've got stuff to do between now at when you file 2020 taxes.

I don't know how you have 2020 unless you have a time machine.

Do you mean 2019 which you filed in 2020?
