Re-entry delay in returning to US

Hello all,

I am wondering if others are in same situation as myself.

I have the re-entry permit (to keep the green-card).  I am in Australia, we are unable to leave international boarders, due to Covid. It's unsure when these boarders will be opened. Will the deadline expiry date of re-entry permit, be strictly adhered to, if I can't return back to the US in time?

 I fear that I may lose the GC. Cheers

Hi,

 

The expiration date on the Re-Entry Permit will be strictly adhered to.  

The big problem with an expired Re-Entry Permit is that an airline can refuse to allow you to board.  If the airline lets you fly with the expired Re-Entry Permit, CBP will let you into the US.  

While Australians are not permitted to leave Australia, you would qualify for an exception if you are traveling outside Australia for more than three months.  Do your best to get this exception and head back before your Re-Entry Permit expires.  

 

If the Re-Entry Permit expires, you may apply for an SB-1 visa.  There is no guarantee that Covid will be an acceptable reason for granting a SB-1 visa.

The following exemption should apply, assuming that you really are still a resident of the US:

 

You are exempt from travel restrictions, and can leave Australia without applying for an exemption if you are:

  • ordinarily resident in a country other than Australia
