Work before I751 receipt Notice?

 Share

My conditional green card is expiring in 2 days, and my attorney submitted I-751 packet for me a week or so ago. We know that our packet has arrived a few days ago, but we have not received our Receipt notice yet.

Am I allowed to legally work after my conditional green card has expired but I have not received the I-797 receipt notice? I have been employed, and I need this income.

Your status has not expired......only your evidence of status has expired. You are fully authorized to continue work.

Thank you, but is there anything I need to submit to my employer?

No, and they can't ask for anything either.

No and unless you are working for the US government or similar  job which I doubt, they Shouldn’t be asking you for any of this. I’m curious as to what type of employer’s keep track of their employees immigration status (once it’s verified they can legally work). Care to share?

As others have said, yes, you are allowed to work.

Second, do you know why your attorney waited until virtually the last minute to submit the I-751?  Many DYI people have theirs ready and send it at  soon as they are able (90 days), and sometimes they even send it in too early.   I suggest you keep in frequent contact with your lawyer until you get your I-797.

Immigration lawyers are the worst lawyers and they're often worse than useless because they make your case more complicated.

You file your I-751 90 days before your green card expires.  In those 90 days you would have received your NOA extending your green card for 18 months (approx).  Why did you wait so long to file your removal?

You could get by with showing your DL and SS, I would still give them a copy of your green card and give them receipt that you have submitted your I-751.  Also as soon as you get your NOA extending the green card give your employer the copy.
