I-130 Affidavits for Proof of Bona Fide Marriage

Hi,

I am getting ready to file my I-130 and have read around here that affidavits from family/friends have little impact on your application. However, I wonder if it makes my application weaker to leave them out?

Has anyone had success without adding affidavits? 

Also, do the people writing the affidavits have to be US citizens?

If you can get them to write affidavits, I suggest you include them. I thought of leaving them out but my husband wanted to include them since we already had them anyway. Please make sure the affidavits are signed. We included photo IDs of those who wrote affidavits for us too.

they’re just one form of evidence depends on how much other evidence you have and your situation..

 

when I submitted my i130 late 2018, 2 statements from my hubbies family were all we had in addition to evidence of travel to/from USA and a marriage certificate ours was approved... 

 

if you have them, attach them if you don’t and have plenty of other evidence E.g. travel, bank accounts, insurance or joint assets then I wouldn’t worry too much about them.. ideally from USC’s it family Or friend of either side is fine provided they can witness a valid relationship

Evidence of time spent together in-person is your strongest evidence and that is where your focus should be.

Tends to make the petition weaker as it can lead to questions that would have never been asked of sufficient primary evidence is provided.  Only use when you have weak evidence.
