Just to make it easy for you to understand. If you do everything right, your gf will not have an interview until after the year 2025.

You can't even file the K1 petition until after you become a US citizen.  That means it will be around 5 to 7 years from now before your gf even gets an interview at the embassy.

You will need to familiarize yourself with the K1 Process in place at the time when you are eligible to file. 

 

For example, currently you would submit a copy or the "Certified Copy of Divorce Decree" with the petition and have the fiance take the hard copy to the interview.   In 6 years or so the process can completely change and you might be divorced again.

If marrying in the Philippines is important to you and your gf, consult with a family lawyer in the Philippines to advise you on your options.

 

If you are ok with marrying outside the Philippines, consult with a US immigration lawyer to advise you on the best path forward.  Preferably one who works with divorced Filipino clients.

 

Although we noted some possibilities for you in this thread, a competent lawyer could advise you about any complications with your case.  The confusion that people here have about your circumstances makes me think that yours is not a straightforward case.  Get a lawyer.

 

As others have mentioned, the good news is you have many years to sort this out.  I wish you and your gf good luck.

OP keeps asking "What should I do?" but doesn't seem to understand the core problems and is only focused on bringing current girlfriend to the States as fast as possible - check

 

Yeah, @ryan villa, you now have a huge expensive problem and you did this to yourself.

The obvious option not so far mentioned would be for you to be the one to move.

Really?  If he lived with his GF he could be accused with adultery since he is still married in the eyes of the government.

That is bigamy?

 

Not being married and living together seems very common, well going by what I see on this Forum.

Technically, he could be accused of concubinage.  Adultery (as far as Philippine law is concerned) only applies to a married woman.  Both concubinage and adultery are punishable with prison time.  But then, the "aggrieved" parties in the Philippines rarely sue...

But an ex USC wife might.  Just saying it is not so obvious a solution as was originally presented and it is a criminal matter that doesn't require an aggrieved party to sue

My guess is that since he was an IR1 that their families may know each other at least to some degree.

Not disagreeing with you.  Just noting that under Philippine law, there's a distinction between adultery and concubinage.  Only married women can be accused of adultery; married men, concubinage.  Burden of proof and possible prison sentence differs, with the law favoring married men (yes, yet another sexist relic in Philippine law).

 

I also agree that moving to the PH would not be an obvious solution to what the OP seems to want -- marry gf.  Can't marry in the PH as OP is still considered married there.
