A dual US-PH citizen is a US citizen and a Filipino citizen at the same time.  You keep saying she is a US citizen, but why did she put "Filipino" as her citizenship on your marriage certificate?

 

You are not giving us a straight answer.  Is your ex-wife a dual citizen?

She is us citizen mam. Not dual, sorry

and because she just turn 21 when we got married mam and she put filipino so she wont get petmit anymore in us embassy

The good news is that he is going to have plenty of time to make sure that this new relationship is the "one"!

Your Contract for Marriage states you are both Filipino. So a Foreign Divorce is not an option.

 

Does she have a Filipino passport?

Yes as far as USCIS is concerned.  in 5 YEARS

But she will not be able to obtain a CFO sticker to immigrate.

 

Lawyers - many.  You need many lawyers.  $$$$$

You are not clearly understanding the multiple issues you have.

 

First you are not divorced as it pertains to marrying a Filipina that resides in the Philippines.

 

And then you can not file for anyone until either you become a Citizen with is at least 5 years of your first green card (K1 or spousal) and for 5 years as a LPR (Spousal).   You will also need to do a divorce waiver based ROC.

So the only way is get my gf is being a us citIzen and file for k-1? No spousal visa right
