  • You cannot marry your gf in the Philippines because you are still considered married there.  You need to get your foreign divorce recognized in the Philippines, if possible.  Is your ex-wife a dual US-PH citizen?

She is us citizen and i am the only filipino. And on our married certificate indicates she is filipino on status on citinzenship.

If you are the only filipino then why does your marriage certificate shows that she's a filipino as the. status of her citizenship?  Was she born in the Philippines?

It's really hard to help you when you will not answer questions from people trying to help you.  First thing you need to do is answer our questions so we can help you.

Huh?  Did your ex-wife lie on your marriage certificate?  Or is she in fact a dual citizen?

 

YOU NEED TO GET YOUR FACTS STRAIGHT because this point has major implications on your future with your gf.

Your wife is a dual citizen of the Philippines and the US.  She acknowledge on her marriage certificate that she is a citizen of the Philippines.  I believe this means your divorce is not valid in the Philippines.  You will need to get an annulment.

Does not matter that she is a US citizen.  What matters is that she is also a Filipino citizen.  Filipino citizens can not get divorce unless one of the party is not a Filipino.  You and your exwife are both citizens of the Philippines.  You need to get an annulment in the Philippines.

You have to do an annulment.  OR Girlfriend gets residency elsewhere and does the interview elsewhere - but you still have to wait to file for her for 5 years after getting your green card.

 

AND YOU WILL BE A BIGAMIST if you return to the Philippines without the annulment.
