Consulate told us the interview appointment that was given to us by the NVC is wrong

Hello,

 

So, today my brother was supposed to have his interview, (the NVC sent us an email that our case is currently at the embassy and the interview is scheduled for Oct, 21st), but the consulate turned down my brother telling him that he was given the wrong date because they are not processing his type of Visa. Could this be due to trump immigration suspension laws ?

 

Note: the NVC completed the process with approval on June, 30th under and IR2 visa Class.

My brother turned 21 yo on Aug, 13th 2020

The NVC sent the email about the appointment on Sep,  with an IR2 visa class.

2 days later I noticed that the Visa class on the CEAC changed to F11.

 

Any idea how long will this take ? or what should we do ?

Timeline

F1 visas are suspended until the end of 2020.....at the earliest.  If that is his true category.  Sounds odd.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Huh?  That should not have happened if the parent who petitioned your brother is a USC and your brother was under 21 then.  What is the PD of the I-130 petition and what age was your brother at that time?

He was 19 when we submitted, 20 when USCIS approved and before 21 when the NVC approved.

Just checking -- did your brother put his correct birth date on his DS-260 form?

Yes everything was put correctly, in fact they just asked him how old he was, and he said 21 and they turned him down.

I don't think they checked anything else.

Exactly ! should he return to the embassy ? because it is clearly that they made a mistake.

It’s the consulate that updates CEAC so I suspect someone at the consulate misclassified it when they received the file. It’s unfortunate that a query was not raised back when you noticed this change.

would it be an issue now ? Can't he go back to the consulate tomorrow and show them that he has the right for his interview ? and that he's still IR2 ?

I don’t know how that particular consulate works. Most don’t let people in without an interview letter, I think if he just arrives like that he is unlikely to get past security. He or you should at least call someone in the consulate about this first rather than just try arrive.

Wouldn't they consider the fact he had his interview today ? He went back just few minutes now, and the security guard told him to come back tomorrow at 8 am, so as the person in charge will look into it !

Do you think there's a chance he could get it done ?

Well if the guard told him he would let him in, sure. Please update us, I am assuming the CO in charge will realize it was an error and go ahead with the interview.
