Hi! We're currently working on submitting our paperwork to the NVC but I have a question. I, the petitioner and American citizen, did not file an income tax form for 2019 due to being unemployed and not generating any income as I was living in India in 2019 on a spouse visa of Indian citizen that did not allow me to work. Basically, I had $0 income of any sort in 2019. WILL THIS AFFECT OUR NVC PROCESS? Please continue reading.

 

I have drafted a letter explaining why I did not file 2019 taxes and can submit bank account statements, 2018 tax form, passport stamps from India, and spouse visa from India. I did not work from July 27, 2018 till June 1, 2020 but have been working since June 2, 2020 and can provide paystubs, job verification letter with employment history, apartment lease, electricity bills, and bank statements to show that I can now financially support my husband.

 

Please advise. Thank you!

You do not need to file a US tax return for 2019.  Completely unnecessary.  

 

Follow the I-864 instructions and provide a signed statement that your income was below the threshold requiring you to file in 2019.

 

Being unemployed for nearly two years and being employed since June 2, 2020, will make it really hard for you to meet the I-864 requirements by yourself.  You may want to get a Joint Sponsor.
