K1 NOA2 expedited approval request process

Timeline

Does anyone have experience with the process of requesting an expedited k1 approval request for "urgent humanitarian" reasons? Currently my wait time has been just over 4 months, and I assume another 4 months of waiting I should have NOA2 approval. My fiance is venezuelan and there many crises that cannot be helped there by me sending hundreds of dollars such as total lack of gasoline, propane, and staple foods, as well as threat of societal riot and rampant crime. These issues have been present for a decade but the world financial/pandemic crisis has brought it to an extreme level these past 6 months. But on the other hand, I believe the Bogota embassy hasn't started processing post NOA2 K1's so the expedited approval may not help in my case. If it will help my case, what sort of evidence and arguments do I need to make for the request?

I tried for an expidiated and was denied because my fiance lost his business has had covid and then dengue fever for 4 months and was denied. I have sent thousands of dollars for medical services and for him to survive. I looked into humanitarian reason first and they said it doesnt fall under the category so I tried for financial hardship but got denied real fast.

And he lives in Honduras so it is bad also like Venezuela. but all you can do is try. Gather your supporting documents for when they request them. Best of luck

You can try, but remember that many other beneficiaries from Venezuela would be in a similar situation as your fiance.  So what would make your fiance's case more urgent than all those others from the same country?

 

Also, note that expedites are usually granted on the basis of hardship on the petitioner, not the beneficiary.  But it won't hurt to request anyway.  Good luck.

First be sure you follow the guidelines for the request to expedite and that you meet their requirements. Anyone can ask for their case to be expedited but must follow certain criteria. https://www.uscis.gov/forms/expedite-criteria.  If accepted or denied neither have an impact on any other process toward a visa. 


1. For USCIS refer to https://www.uscis.gov/forms/forms-information/how-make-expedite-request
2. For NVC they expedite K-1 visas already.

3. For Embassies, an expedited request requires you to contact them either through email or a phone call. Most embassy don't grant expedited visas but only in the case of an emergency. Check with your embassy for additional details.

 

Chapter 5 - Requests to Expedite Applications or Petitions


Benefit requestors may request USCIS to expedite the adjudication of their applications or petitions. USCIS considers all expedite requests on a case-by-case basis and requires documentation to support such requests. The decision to grant or deny an expedite request is within the sole discretion of USCIS.

I am curious what you mean by point 2: 'NVC they expedite K-1 visas already'

There is no document screening done by NVC for K1 cases, unlike CR1 and other family-based visa cases.  So nothing to expedite at NVC stage for K1.

For the K-1 visa NVC does not expedite as your file will pass through (normally) within 1-3 weeks. Pandemic has stopped file from being sent to the embassies. Some embassies are beginning to ask for their files as they have begun the interview process for K-1's.
