Hi everyone!

For evidence on my I-864, can I submit my previous W2s instead of my tax transcripts? In 2017 and 2018, I filed jointly with my former spouse, and these do not list my individual income.

Only the latest return is required (2019). Tax return + w2 or tax return transcript is mandatory.

It doesn't matter who you filed with. You will write down exactly what the total income was for those tax returns.

Current income is not necessarily the same thing as total income from the return.

Thanks for your response.

I am adding the other two, as I was overseas and did not meet the requirement for 2019. I want to show that, when in the states, my income meets the requirement.

So even though my ex-spouse is on the tax return, I should put the total combined income for those tax years?

Past income doesn't prove current income. Showing 3 years of tax return only helps if you have a consistent income throughout all 3 years, and I would say preferably from the same source, but you still need to prove current income. You already said that you didn't have enough income in 2019, so there's no reason to send 17/18 returns. Your income wasn't consistent throughout all three years.

Are you in the US right now? Do you have a job right now in the US? If so, use the information from current employment to prove income. Your salary, paystubs, letter of employment...

If you're overseas, (and working overseas until you move to the US), then you need a joint Sponsor since you won't keep the same income after moving.
