Hi everyone!

 

Long story short... I (Em) am a British citizen who moved to the US in August 2019. My husband and I are hoping to move to the UK together. I've applied for a great job in the UK, which is above the minimum income of £18k required to bring a spouse to the UK. 

 

It's been a really rocky road since moving here. My hours were cut back and I have not made enough money over the past 6 months for my husband to immigrate immediately, with me. Even with the covid-19 changes made to the rules, I still didn't make enough money. 

 

My plan:

- get a job offer in the UK (a job earning at least £19k)

- move back to the UK and bring my US citizen husband with me

- US husband can stay with me in the UK for 6 months. At that point, he will have to leave. (Tourist visa: 6 month max)

- husband returns to US and begins the application for the family based visa. He'll probably spend some time with family / friends while back in the US. And He'll use his mum's address, as he won't be living where we currently live. 

- once he's submitted the application, he can come back to the UK and spend some more time with me?

- hopefully 3-4 months down the line, he will return to the US to finish up paperwork/get his visa (I'm not sure how this works)

- then He'll move to the UK permanently 

 

 

Any thoughts? I'd really appreciate any advice.

I know a US citizen on a tourist visa can stay in the UK for up to 180 days per year. Were you planning on leaving 6 months between his two visits, or is the law different for family visa applicants?

Also, I am sorry to hear things haven't worked out so well, I am moving next month and also nervous about all of that stuff. Can I ask which part of the states you moved to?

I’m only familiar with UK —> US immigration, but is there a reason you’re not planning on applying for the family-based UK visa until after your husband visits for six months?

 

Immigration (as I’m sure you know, having moved to the US) can take ages, and I would think you’d want to start the proceedings as soon as possible after getting a job in the UK. Especially considering potential COVID delays and immigration backlog. 

 

Also, seconding the 180 days per year thing. I think once you reach the max, you need to wait until the next year. So if he comes to stay with you for six solid months, he’ll likely need to be out of the UK for another solid six months. 

 

Does your husband work? The ability to hop back and forth across the pond somewhat at will suggests to me that he doesn’t, but if he does, is there a chance you may be able to use some of his assets/joint savings to bolster your case? I know you can use the beneficiary’s assets in moving to the US, but not sure if it works that way in the UK.

She has to hold a job earning more than £18k for six months before she can apply to bring a spouse. So she plans for him to be a visitor while she meets that requirement.
