Timeline

We filed for AOS from the K1 back in March. I am also in my last semester of graduate school. Up until my last semester I was able to also continue working full time, however, my last semester is also my internship and so I have been without a job since the end of August when I started my unpaid internship. We just received notice that our AOS interview has been scheduled. We haven't received our actual notice in the mail yet but I am guessing that it will be sometime in December, which is also when I graduate. When I graduate I will have an advanced degree is a subject that is much in demand right now and do not expect that I will have a hard time in finding a job. My internship site has already expressed interest in having me stay with them when I graduate. My question is- will the fact that I am finishing school have an effect on our interview? Between savings, investment accounts (not including 401K), and equity in my house I have a net worth of low six figures.

AOS

08/25/2020 - Sent I-130, I-485, I-131 and I-765 to Chicago Lockbox using USPS                                         11/06/2020 - Received physical receipt notice for I-765 in the mail

08/28/2020 - Package was received by USCIS                                                                                                   12/15/2020 - Online account updated and indicated the I-944 RFIE was sent

09/25/2020 - Debit Card was charged by USCIS                                                                                                 12/28/2020 - Recieved the I-944 RFIE via e-mail after speaking with a tier 2 officer

09/29/2020 - Recieved text notifications from USCIS with reciept numbers                                                  1/11/2021 - Responded to the RFIE and sent the I-944 to USCIS 

10/01/2020 - Recieved rejected I-765 back                                                                                                           3/3/2021 - Biometrics scheduled for 03/29

10/05/2020 - Recieved physical reciept notices in the mail

10/06/2020 - Sent I-765 to Chicago Lockbox using UPS

10/09/2020 - Package was recieved by USCIS

10/30/2020 - Recieved text notication from USCIS with reciept number for I-765

Man color us jealous, we filed AOS 9/2019 and have been waiting over 170 from the notice saying ready to be scheduled for interview.

Oh man we want to get it done and over with so we can end this 5 year immigration journey. Well at least have a true active status. We are tired of waiting and getting delayed and the runaround.  🙂

Hey! Curious if you decided what to do?  I am in a similar situation. I just started my master's in August (I am the USC) and am still working with my same company, but now just part-time (and am under the income requirement).  I'm thinking of having my parents co-sponsor just in case and bringing the completed forms, so if it is an issue I can present them there (so hopefully won't get a RFE and delay things).  I'm in a nursing program, so same boat of high demand and decent income, but won't finish until May 2021. Also thinking of maybe seeing if my employer would write a letter stating they would have me back as full-time if I would like.

We haven't entirely figured it out yet. The good thing is that I graduate in December and my internship site is interested in having me stay on. If I were you and had someone who would be willing to be a co-sponsor I would definitely do that.

Hey! I was just thinking of something. If your husband has received his EAD and is working, I believe his income can be counted towards your "household income" and therefore would most likely meet the income requirements.  I'm assuming you would want to re-do (or "update") the i-864 and then include him on it. 

 

Just a thought. Still investigating it myself.
