Tax return after wedding for green-card hoder.

I hav two questions as a greencard holder. I wold appreciate if you guys can help me.

 

1- I can’e to know that as a GC holder we have to mention on Tax return that we are immigrant. Our GC can be cancelled if we do not mention that we are immigrant. 

 

2- After wedding do I have to file tax return as single as My wife don’t have SSN or joint return?

130 filed on Aug 1st 2019- Denied Due to printed on outdated form thats was expired on July 31st 2019

130 filed again on Aug 13 2019 

1-797C received with Notice date 08/16/2019

1.  No such thing

 

2.  Married, either married joint if SSN or married separately if not

1. You have it slightly confused, what you have to do is file as a resident. Filing as a non-resident
is what can lose you your green card. 
 

2. As above, you can’t file as single if you’re married. You can file as married filing separately if you want.

File as married

and if she is outside the US when you file next spring, if you wish the bigger refund,  file a W7 for your wife along with the supporting documents so she has ITIN as defined by IRS

mark the ds 260 form when she has to do it so USCIS applys for her SS # and card (if married)

Can I claim my spouse as Non resident NRA on my tax return and file MFS. Would it be considered I am filing non as non resident?

No.  NRA designation is about your wife,  not you.

 

For you to file as a non resident,  you would need to use form 1040NR.

A taxpayer can never claim a spouse as a dependent.

You have two choices.  1.  File MFS and report only your income.  2.  File MFJ and report your and your spouse's income.  You would need to file a W-7 to obtain an ITIN for your spouse.

There is no place that the tax return asks you to state status.

If married, you don’t file single

If you file Married Filing Separately using a Form 1040 you are filing as a resident. It will ask for your spouse’s Name and SSN. Give her name and write NRA for SSN (which is describing her lack of a ssn, not how you are filing).
