My question is on prior marriages and if any of you have been through same the same situation and that is, I was married back in 2011 and filed for I130 for my spouse at the time and we were approved it was in Ethiopia , but things didn’t work out within our marriage and we decided to file for divorce in 2015, I met my love now 2 years ago who is also from Ethiopia and we are planning to file for a K1 visa, I’ve traveled to Ethiopia 3 times to see him and we instantly fell in love! We met through mutual friends on Facebook, my concern is will USCIS give us a hard time because of my previous marriage? We are truly in love and we wanted to get married here in the U.S. once he gets approved at his interview for his visa to come, that’s if he gets approved.. Thank you!

They look at all previous marriage especially if there was an immigration benefit conveyed.   Make sure that have met and spent significant time together and front load the petition.  Consider a spousal as it can be appealed if it is refused.  A K1 can not be appealed.

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

More an issue for the Consulate.

The vast majority the time you or your fiance will not give you a hard time about previous spouses unless there was some type of DV issues going on in that marriage. But do not be surprised when your fiance is asked about it at the interview. I have seen some consulates use that question to help determine if you have a bonafide relationship or not. Someone came on here and complained at the Manila embassy because his fiance was asked about the petitioner's previous marriage and he never told his fiance that he was previously married. So of course there was an issue there

As long as the divorce is finalized and you have the divorce decree then there is no problem.
