Good Evening,

 

My husband had an interview on June 9, 2019 at U.S. Embassy in Bangladesh and after the interview they said everything was okay and that he can pick up his passport within two weeks. But his passport was ready within four days and when he went to pick up his passport the visa stamp was not on it. Since then we have been contacting the embassy, emailing them as well as calling them. They just reply with that its still under processing and does not say anything further. What can i do? It has been 16 months since administrative processing. If anyone can help me. My husband and i have a US Citizen child together. The delay on his visa approval is causing hardships for me and our child. Please help

Usually they will give you 221g Form at interview or send you via email if they need additional docs.  Does your husband have travel history.

 

Try contacting your local congress office for help

You can contact your congressperson and request them to inquire about the case on your behalf.  Note that they may be able to get more information from the embassy but they cannot influence the processing of your husband's case.

 

As a last resort and if you're willing to spend thousands of dollars, you (and your lawyer) can try a Writ of Mandamus lawsuit.  This will force the embassy to take action on your husband's case, although it does not guarantee that the result will be issuance of a visa.

Nope they didn’t give any form nor did they ask for any additional documents ! 
my husband does not have a travel history 

 

& yes I’ve contacted 2 senators and the local congressman ! I have tried literally everything possible

i got my passport returned but they sent me 221g for DS 5535

Writ of Mandamus (WoM) is a lawsuit that you can file in federal court to force the relevant government agency to decide on your immigration case.  This should be taken as a last resort.  In addition to costing thousands of dollars in legal fees, WoM does not guarantee visa approval.  It simply compels the agency to make a decision, either to approve or deny the visa.

 

I know of only 2 reports of completed WoM here on VJ.  One resulted in the visa being granted.  The other resulted in the petition being sent back to USCIS and consequently, additional years of delays.

There are many more than 2 successful mandamus cases on vj  alone just search the ds5535 thread.  I know of more than a dozen who received their visa on 2 months.  About a half a dozen who had extensions but still received visas a few months later and only one return but they knew it was going to be returned anyway but was just sitting at the embassy.  

 

 

It is an expensive process but if you are already traveling every few months to visit the cost is about the same as a trip or two to see your spouse.

 

It does require the agencies to make a decision and does not guarantee a visa but if you are waiting for a year or so its worth having any answer then complete silence.  

 

It is a personal decision that ine must make when they have just had enough.

Mandamus is the only option for to push forward the case or other wise you can site and wait for their prolong decision. If they are not able to give the visa then they will refuse anyway. But refuse has to be according by their visa law.

Have you got any response? After the interview does it says issued and your visa has been printed?

When he had his 1st interview on june 2019. Did you check his ceac satus ? Do you remember what was it ? Was is AP ? Or like Issued and saying that your Visa has printed

It said AP , and now says Refused but still under AP !
