For past few days I have been wondering if the newly proposed premium processing is available for C-9 category for US citizen sponsored spouse AOS. Just wanted to see if anyone has an idea about it. 

can we apply for one if case is already filed?

No. Premium processing is not available for C09 EAD.

 

If you have a job offer in writing you can attempt an expedite for the EADhttps://www.uscis.gov/forms/forms-information/how-to-make-an-expedite-request

It's not available yet because USCIS has not implemented the new law yet. I think they are too busy pushing out regulatory changes that are hostile to immigrants so they don't have time to do the premium processing expansion yet.

 

You can check https://www.uscis.gov/news for updates if you want to know when they start doing it.

Yes, I noticed that USCIS is misrepresenting what the law says, which is not surprising given e.g. how they reacted to the SCOTUS ruling on DACA.

 

The premium processing expansion is not optional. USCIS is required to implement it (but they can suspend it at any time if they determine that operational constraints prevent them from being able to actually complete premium processing cases within the time period).

 

Whether they'll actually do so within a reasonable amount of time, and what excuse they'll give if they end up not doing it, well... I have thoughts about that but I'm not sure if politics is on-topic here, so I'll stop now.

I am trying to make an expedite request in connection with an EAD.  The web page says to call the Contact Center, but there does not appear to be any way to get past the new automated interactive voice response system.  If you say you want to make an expedite request, it just texts you the same instructions to call the same number.  There's no option to wait to speak with a person to actually make the request.  Anybody find a solution to this??
