Need help: I-751 Pending, Should I file N-400?

Hello All,

I have a quick question and I need advise. I recently got a RFE for my I-751 and I responded to the RFE and USCIS have acknowledged that the response was received. My window to file for N-400 is going to open in a week. Should I go ahead and file the N-400 or wait and see the I-751 through before filing the N-400? Please advise. Thanks a lot for the help.

I agree, get the N400 clock started, no need to wait for the I751 to wrap up before filing.

Thanks would there be any delays or complications with submitting the n-400?

Hard to say since I751s are processed in service centers and N400s are processed at a local office.  In theory, if an I751 is active, and a person files an N400, both applications should be combined and sent to the local office and usually that happens, but YMMV on that one.  I can say when my wife had her pending I751, she filed the N400 when our local office was processing those rather quickly, and the I751 was properly sent there.  At that time, I751s we’re taking over 18 months to process, but her N400 was processed in less than six months, so she was done fairly quickly.  You may want to check out this thread of others that have recently filed the N400 with an I751 pending, they may have more current information of what is going on.

Good Luck!

You should look up the processing times in your local office. For some people, filing for citizenship can really slow down the process of ROC. It's not always the best decision to file. If you're headed for an interview and your local office is fast - then file for citizenship. If your local office is slow, filing for citizenship can easily add a year or two more to your processing time for ROC. It's definitely a risk.

I this case, filing for citizenship will probably not hurt you, but of course, who knows with covid.

I agree. I will wait to see out the I-751. I hope they don’t take six months to make a decisions after my RFE response

they wont approve n-400 until I-751 is approved. in some cases i have heard filing n-400 pushes i-751 for approval. so no need to dealy filing n-400

duh

Since you already received an RFE you're likely very close to an approval (if you sent enough evidence with your RFE response, that is). If it was me I would definitely wait and just have the ROC done and over with before starting the N-400 process since you seem to be very close to an approval.
