864 or 864EZ ?

my husband is a US citizen, our I-130 has been approved. he is the only petitioner, i am the only immigrant (no children). we were wondering whether he could use the 864 form or whether he needed the 864EZ?

We used I-864EZ for AOS, it is intended for simple situations and is usable in place of the I-864. (No asset data, no joint sponsors, no additional immigrants)

If your husband uses only his income (no assets, no co-sponsor), then he should use I-864EZ which is a simpler version of I-864.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Another question about this.

I can meet all the financial requirements, but my wife will be coming with her step daughter.

However, since I am filing I-130, each form is only for 1 immigrant, even though the daughter is listed on the form.

So, it is not clear to me.

The form I-130 is for only 1 immigrant, and that is the form the I-864 applies to, however there is another I-130 in the system for the daughter.

Can I use 864-ez, or just not worth the risk, fill out the long 864 and forget it ?

Talk to NVC about it. But I think, you need one I-864EZ for your wife and another I-864EZ for her step daughter. Again, you use I-864EZ instead of I-864, if you are using your income only.

If the step daughter is a minor (under 18, but it could be 21) then you need to file I-864W for her.

You are better off filing I-864 for your wife.

Check with NVC, just to make sure.
