Local office says they don't have I751, inquiries say otherwise

Timeline

So, our I751 has been pending since 12/2018. The last update we received was in January 2020 stating that the case was transferred to the local office.

 

In August, we made an Infopass appointment. We drive 2 hours to the Infopass appointment and they told my husband he could not have a stamp because his N400 interview was scheduled and his I751 would be taken care of the same day. So he went without a license and proof of status for a month.

 

In September, we go to the N400 interview. Everything goes well, but they tell my husband it can't be approved because they don't know where his I751 is and they can't find the documents. They tell him a few more weeks and send him out the door.

 

He comes out and tells me (since I wasn't allowed in) and I obviously freak out that they claim to not have or know where the I751 is.

 

I go up to the door and demand to speak to someone since my name is jointly on these applications, I felt I had the right to be told what was going on. The supervisor comes outside and we discussed the issues in front of literally everyone in line (which I felt was inappropriate). He fed us BS lines that the office processing thousands of applications a day, then he told us our I751 was in Vermont, then he said maybe they'll find it later, then said maybe its at the NBC, and even smugly said "if we determine your marriage legitimate we'll approve it". I was very upset and crying. He could not give any explanation about why they told my husband our I751 was missing.

 

I did a few case inquiries before that stated the I751 was in line for an interview at the local office. We were told it was there a month earlier and well now it suddenly vanished.

 

We literally had to beg for a stamp so that my husband could renew his license and start working a new job being he just graduated and got his nursing license. I can't believe people have to beg for these stamps...

 

Anyway, the stamp expires in October 2021... I was guessing we'll be in this situation for awhile. N400 completion date changed to 01/2021 on the account.

 

Last week I did a case inquiry and the email said the case is "pending decision we can not provide a completion date" at the local office. I feel like they're messing with us. I wrote the senator and got back the same exact thing "pending decision at local office".

 

I don't really know what "pending decision" means, hasn't it been pending a decision since we submitted it?

 

I am just really confused as to why they told us the I751 wasn't at the office, when with every inquiry we're told its at the local office. Are we missing something from the story? Are they just not telling us something? Anyone been in a similar situation before?

USCIS is a crappy mismanaged organization. they will tell you anything to get you off the phone/ enquiry. Honestly you should file a case at a Judge. Its called Writ of Mandamus( google it)  asking a Judge to intervene and get USCIS to adjudicate the case 

 

This kind of behavior is very much the norm with USCIS. it is getting worst under the current administration

We considered the Writ of Mandamus. I read that USCIS has 120 days after an N400 interview to make a decision. If we don't hear anything by then, that's the route we'll go. We're sick of this and just want it to be over.

your case processing time is beyond mind boggling. 2 years for i-751 is very very high . apparently USCIS think they can take forever to process petitions and it should be acceptable by applicants. WOM is the only way to get adjudication now a days

Yes, it's getting crazy. I've now been waiting 225 days since N-400, and it looks like I'm going to have to file WOM to get it resolved.

 

The only reason I haven't so far is down to the cost.

That's crazy and certainly not promising since my i-751 has been pending since 9/2018 and I've already done my n400 interview as well. I'm going to call USCIS and speak with a tier 2 to see if I can get any info. The case inquiries are useless they will never give you any real info you need to speak with a human. Have you contacted your States representatives? Others have found them somewhat helpful.

  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:

Yes, I've had Congress people make enquiries, and they just got generic responses from USCIS too.

 

My I-751 was approved 3 weeks after the interview FYI, that had been outstanding since 6/2018.

 

At the time of the interview they did say they didn't have my A-file, so maybe I have a similar problem where the file hasn't made it to the local office.

I can never understand USCIS. I thought we only had one A file. If they have the n400 they should also have the i-751 shouldn't everything always be together. My A file was sitting on the desk at my n400 interview but that office didn't have my i-751 or so they said. My n400 interview was only 2 weeks ago so I'm going to wait for a while and see what happens.

They claimed not to have our I751 file in office either, despite the last update to our case in January was case received at local office and being told it was there a month earlier. We thought everything would stay or link together. 

 

I saw your timeline, your N400 interview was a day after my husbands. What is your local office being the situation is somewhat similar?

I saw your timeline, your N400 interview was a day after my husbands. What is your local office being the situation is somewhat similar?

My local office is Queens NYC but part of my issue is that I moved. When I moved seems only part of my file got transferred which I didn't think was possible!

Timeline

We moved too during the process right after filing N400. We went from Philly Office to Mount Laurel, NJ office. Maybe our I751 is still in Philly despite being told it was in NJ? It wouldn't surprise me if it was. I assumed everything would move together too.

Sorry my mistake, the interviewer didn't actually call it an A-file. She had a file on me there, but said the I-751 file wasn't there.

 

From what's I've read, the N-400 is electronic, but the I-751 is still a paper file.
