Spousal passport surname question

Hi!

I'm in the process of completing my wife and son's documents to submit to USCIS for visa. I married my wife 2 years ago. Her existing passport is valid for 10 years and her surname in that is still when she was single. Will there be no issue if I submit her passport with her surname when she was single? Updating passport now takes months due to pandemic slow times. Ty!

Not a problem.

 

If you send in her passport with her maiden name, then her immigration visa will list the name in her passport.  Her green card will list the name on her immigration visa.  So, her green card will have her maiden name.  If you want her green card to have her married name, you would need to send in the green card with her maiden name, the I-90, and pay the fee which is around $455 + the the $85 biometric fee.  

USCIS does not have anything to do with visa, they only process the I-130.  Are you submitting the I-130 to USCIS or the DS-260 to the NVC?


F2a are not interviewing until next year and you'll have to get in line behind all the cases that have been delayed for interviews since March 2020.  Plenty of time for you to update her passport with her married name if you want her green card to have her married name.

Passport ID page submission is not required unless alien is already inside the USA
