You can pay a lawyer to get an “expert” opinion to tell you the same thing.

How does telling you that sure you’re fine and no problem to get F1 help you by being “positive” and “encouraging” if it’s wrong?

Ok let's break this down.

When did the "Extension" of the B2 expire? September of 2020?  If so the COS for the F1 won't be valid if the 2nd COS from B2 isn't approved. (Your extension has expired)

 

Is the I-20 from the school still valid? Hopefully it from a school with a solid background in international students.

Creating an anchor baby isn't a plan to stay in the US.  Getting an extension once is hard enough.  Getting an extension twice is very rare.  Getting a COS to F1 is after getting an extension is even tougher.  Your lawyer will earn his money.  Obtaining an F1 requires showing that you do not have immigrant intent.  Having a US Citizen child goes against not having intent.  Being in the US for a year doesn't help either.

 

If you are able to COS, what are your plans of remaining in status with a newborn?

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well
