I would like to ask a question regarding my mom's green card status. She has been a resident, green card holder, since January 2019.  She traveled to Colombia last January planning on coming back in April but due to Covid19 she has been stuck there.  Does she need to file an extension for her staying longer than what it was supposed to?  What are we supposed to do?   Is she at risk of losing her green card? 
Also, she doesn't feel very comfortable traveling for the health risk of being expose to the virus and her age.  There isn't direct flight from Bogota to Seattle. Could she stay longer there until things are more in control.   Any information you can provide would be greatly appreciated.

I understand the health risks but it really comes down to how bad she wants to keep her green card. Sounds like she’s choosing to stay out of the country. They’ve had humanitarian flights for US Citizens and residents leaving from Colombia every month.

What efforts has she made to return?

Hi,

 

Unfortunately, if she stays outside the US for a year, she risks losing her green card status.

 

She needs to come back to the US.  While there may not be any direct flights, she can transit through a third country to return to the US.

 

There are no "extensions" for her to stay outside the US longer than 1 year.  Just not possible. 


Your mom is going to have to make a choice - come back to the US to keep her green card status or stay outside the US for more than a year and risk losing her green card status.
