My experience - I have had sole custody since Day 1, and officially through the Ontario courts since my daughter was 5. Her father had seen her a handful of times and not since her 3rd Birthday. She is now 15.

I went to get her passport last year, custody papers in hand, long birth certificate and everything and the silly woman at the booth still said 'How do I know this is the most recent order for custody?' Good question! How do I prove I'm not showing the paper which gives me rights, but there wasn't another one last year reversing that? I simply explained it to her...also, when my custody papers were drawn up, the judge added specific wording that I could apply for a passport and travel anywhere with the child without the other parent's permission.

I suppose she could have asked me to get some sort of updated affidavit or something.....but I recently went through having them updated in case of travel difficulties and what my lawyer said was that the Ontario judge would just say 'This is the last court order, why does anyone need it validated? THis should be enough, it has the seal on it'

I did eventually get an addition to the original stating that we have not had any further contact with the father since the last court order...it was signed, witnessed and is an official court document. Cost roughly $300.00 for an hour of the guy's time, but well worth the peace of mind

As an update. the bio-dad finally called Passport Canada back, and we have received my future step-daughter's passport. Still waiting on Kristy's, though.

K-1/K-2 AOS APPROVED IN ATLANTA MAY 17, 2006

10 year GC Approved - APRIL 16th ,2009 - Peggy and Jonathan's......

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.
